    The thing is we did write to them early this year and they did not deal with it because they said it was naff all to do with them......:mad:, I reckons I should do some printing off about that above and also enclose them the email from Hamilton.
    Even though Hamilton/AVIVA confirm they have send it, I think we should do this anyway.

    I have emailed the response to the FOS, and her automated response states she will be back on Monday, do you think I should also post these details of what you found as well?

    And did they give you a final response in it?

    Also did FOS not email you to say they will look at the complaint against the ones that have emailed you today.

    No, they didn't they just kept going back to Endeavour, saying to take it up with them or Click.......:confused:

    I have emailed to ask the FOS again on this, but not expecting to hear now until Monday, as she is not back until then, I was going to double check on this, but if its been confirmed that it was HFC I think I am best just getting on with it, due to it being time consuming, and just in case.

    Also if a company receives a complaint and then you do not do anything more with it they are not obliged to reply after a certain time limit. I just get the feeling they may use this one and it is then that the FOS will have to see why in 6 months you have not had time to send the complaint into them. i had the same from FP saying they were not responsible and then I sent it to FOS and waited for them to tell me who to complain to. I know that LLoyds have actually kicked up a fuss about my complaint and said they are not responsible for the rebate even so that is now up to FOS (after all it was FOS that had all my paperwork) to make them responsible if they can.

    Yes they did say that, but I think this was the case if they did not resolve it in our favour. Hamilton that was.

    With HFC they got back earlier in the year to say it was down to the broker and to go through them, they also said Endeavour as well, so did not deal with the complaint.

    But yes they will probably do that, I have sent the details by email to the FOS from Hamilton where this confirms they are stating its them of HFC, but before we did not know where to go with it.

    I emailed Hamilton back to ask for email addy details of HFC, I'm sure I did email them last year, maybe it was the wrong part then......:o, but anyway here's the reply......


    Dear

    I've just phoned HFC Bank but they do not have an email address for the Central Complaints Team. Their procedure is that a complaint will be allocated to one of their complant handlers, who will then contact you and provide a reference number and their details (phone/email) etc.

    I am sorry that I cannot help you further - should you have any more queries, I would refer you to HFC Bank , who will be happy to assist.

    We did not go through these procedures with HFC before, not even allocated with a ref number, as they did not bother looking into it in the first place.

    Di, you complained to both some time ago (just looked back to Jan) and in Jan FOS asked for all the correspondence to assist you further saying that you had now given BOTH companies an opportunity to address the complaint and they would take it on from there.


    Received an email reply earlier from the FOS consultant, about HFC/Endeavour

    Thank you for your email, a copy of which has been attached to the file.

    I note your comments. As we have already contacted both Hamilton Insurance and HFC Bank I feel they have both been given an opportunity to respond to your complaint.

    Please return the complaint form to me along with copies of all relevant correspondence. I will then be in a position to refer this complaint back to my assistance manager for a further review.

    So don't know how any of the companies will respond even if FOS take it on as they may well now say its outside of FOS jurisdiction (which is what happened twice with FP as FOS WANTED to help and it was FP that said "you are not allowed according to the dispute resolution"). FOS did give you the opportunity to take this further without any of them admitting anything. It may be difficult now as both companies have received complaints a along time ago. Still worth a shot but it might no be FOS doing the throwing it out.

    I just wish that we had those details you had posted last night to prove this now, as we did not have these before.
    HFC were governed I believe from 2003 or even earlier, I think anyway, not certain though.

    It doesn't matter is they accept the complaint or not as that is what FOS is there for and to see if they can make them responsible. You still had communication about a complaint from them (even if it was naff off) and did not bother to go on with it.

    It was about the rebate wasnt it and not the mis selling?
    Need to really think now and find old docs.

    From what I remember it was just the rebate, taken it that direction instead of the mis selling, just found some SAR paperwork, and it states Complaint of unfair rebate, not resolved.
