Setanta Hibernia

Options
Warning for previous subscribers to Setanta in Northern Ireland.

Unbelievably I received an email today from Setanta stating my subscription was moving to Setanta Hibernia.

I phoned to cancel but they stated the 30 day cancellation period still aplies and a DD would be collected. After much arguing that it states in the email if contacted within 7 days (see below) there would be no penalty they agreed to change the cancellation date to before my next billing date (next week) so there will be no DD collection made.

Dear Mr,

Following our previous correspondence to you in July, this email confirms that your subscription contract which was with Setanta Sports S.a.r.l has been transferred to Setanta Sports Hibernia S.a.r.l. Setanta Sports Hibernia S.a.r.l will now collect payments due from 1st July 2009. The ongoing obligations of your subscription contract will be fulfilled by Setanta Sports Hibernia S.a.r.l. Should you wish to query the service you receive from Setanta Sports please contact us at the contact number above. Where you contact us within 7 days upon receipt of this letter, we will arrange to cancel your subscription prior to your next payment date without penalty. Otherwise, if you continue to take the service it will be on the basis that you have agreed to the transfer of your contract to Setanta Sports Hibernia S.a.r.l. Billing will recommence over the coming weeks.

The good news is that you need take no action to continue receiving the benefits of Direct Debit. Please be assured this change will not affect the service you receive in any way. The only change you will notice is that with effect from 17th September we will collect your Direct Debits instead of Setanta Sports S.a.r.l. and therefore Setanta Sports Hibernia S.a.r.l. will appear on your bank/building society statement. There is no need for you to complete a new Direct Debit Instruction, as details of the change will have been supplied to your bank, who may also notify you, independently. *Additionally you may also see a comment on your bank statement advising you of the final payment under the old name details and the first payment under the new name. You will continue to enjoy the benefits of the Direct Debit Guarantee, as detailed below. If you have any questions about this change please call Customer Service on this number: 0871 200 4174

  • I have had the same email and the same long argument as you, doublee. Did you realise that your bank account has probably already been debited for July and August payments by Setanta Hibernia? Mine has! I assumed that, since Setanta had gone into administration and stated that no further payments would be taken, I needed to do nothing. It was a shock to discover that my subscription contract has been passed on to what I would view as a separate company. I have been told that I must write to Setanta Hibernia to claim a refund for July and August, but was given no assurance that I would get it. Interested to know if you are in the same position.
  • I noticed a payment to setanta sports from my bank account two weeks ago and was extremely surprised cos I thought all UK customers had their subscriptions cancelled automatically. As no payments were taken for july and august I thought this was the case. I left it a bit late to call them but as payment is monthly I thought I had time before the next bill. Extremely shocked today I noticed yet another payment to them. as soon as I knew of this second payment in one month I called them and extremely complianed. All I got in reply was that I had to give 30 days notice from my next bill... that will include two payments!!

As there were no bills taken for july and august it would seem now they want them back and so billed me twice in one month. I have had no correspondance at all from them as to what was happening or what would happen to future bills or cancelled programming.

I am from Northern Ireland and to me I am a UK customer but Setanta say I still get programming cos I'm in Ireland so they say I still have to pay my subscription.

Why do I have to pay so much to cancel a non contractual subscription?!!!!
  • On June 23rd 2009. Setanta disappeared.

Leaving Setanta Ireland, of which us Northern Irish sports fans get 30% of the matches cos Setanta Ireland switches off the matches.

On the day Setanta went into administration (GB) division...they could not answer any questions...so we cancelled our direct debit. And contacted then as required.

No payments taken, for two months. All we got was Setanta Sports 1. We dont want it. And Setanta Ireland, as above...switches to blue screen for most matches.

    Yet we get this letter.

    And heres the scary part.

WE MOVED HOUSE 21st AUGUST...and SETANTA sent the letter to our new address. Where the hell did they get this address?

What business does a company have, telling us Setanta Ireland runs Northern Irelands viewing when since day one...most matches up north switched off. for no reason to blue screen and all southerners got the matches.

It may be a GB company...but the UK....is a different thing.
What legal rights have I to cancel DD with bank. Not get billed...and then a Luxemborg company with .sa.r.l in the title may ignite a new DD without permission...and I'm presuming...they will restart charging.

    HERE'S the other thing.

HAVE YOU NOTICED IT SAYS CANCEL IN 7 DAYS...YET THE LETTER DOES NOT GIVE A DATE OF CREATION?

How do you prove when they posted it?
These people removed the GB viewing from NI customers...leaving us with 10% irish programming of which none of us really got to see any matches.

And is Setanta Ireland going to show the matches we want to see?
    No cos ESPN owns them.

    A$$holes.!!!
  • I got the same letter yesterday (Wednesday) and only after checking my internet banking there now, they have taken 2 payments of £9.99 and £2.99 since I had multiroom!!

When they went into administration on June 23rd I cancelled my direct debits with them, and I thought that was the end of it.

How can they just create new direct debits without your permission or consent ( i didn't even get 24 hrs notice from when I got the letter!!)

How can they even justify a price for their service also? All the matches they show Saturday at 3pm are blocked out her in the North!!

I will write to their Newry office for a refund.

    I hate Setanta!!
  • We all have to write to their Newry office.

We have to be aware they will pull the Great Britain isn't United Kingdom crap.
But we do not get premiereship matches. Hence wny most UK peeps canceled DD before administration.

And why most NI peeps did too. As we were always aware the matches up here didnt show.

So what exactly are we paying for:

A service where 70% of programming died upon GB Setanta's death. Left with 30% of an Irish service none of us want. For matches we don't see.

The only thing more disgusting than the Luxemburg division starting these DD's without permission...is the fact they sourced my new address.

Lemme guess...SKY must had divulged that to them. How dare they!!!!
  • What rights do we have if they say we got 7 days cancelation period when:

The letters were purposely sent 2nd class!!!!
The letters were NOT post dated on the envelope nor on the letter itself!!!!

So how do you prove when you received the letter to make use of the 7 day period?

I will quote their letter to them.

As far as I know it is against the law to start a Direct Debit without the cutomers consent. A direct debit is started by a Customer not a business.

But I've always heard if you paid by credit card...that's when it's difficult.

    Best thing:

Phone, get address or chose to write RECORDED to the address to cancel. Keep the recorded letter's tracking number.

Request in said letter to cancel per their 30 days rip off notice thingy and whilst re-cancelling the Direct Debit....say they will receive payment needed by cheque.

Going to call them this morning.
    Forgoing that we'll write recorded.

As for their previous letters they sent out in July....I betcha none of us actually received those 'figment of their imagination' letters.

    **sighs**
  • We need to get the address up here. As I hear they fob you off with different addresses. We need to find out if their Newry office is still there.

Their is a new Hibernia address so that will have to go up here too.
Then there is probably a southern address as well.

And if sucessful we got to ask for receipt of cancelation.
  • Just off the phone with Setanta, and cancelled my account, the guy informed me that my main and my multiroom payment that were taken today could not be refunded, but he would close my account with immediate effect so that no more payments would be taken.

They must be deperate because he offered me my multiroom subscription FREE for 1 year!!! I just said I am not interested because why pay for something that the majority of the things that I would be interested in watching are not available in my area!

Hopefully that should be the end of it!!
  • Just came across the 9.99 missing from my bank account today and have been sorting it out for the last hour. Phoned and they are cancelling my subscription which I had previously done in June and they actually had a record of this on their system. Spoke to my bank who can't understand how a different company could set up a new direct debit without my knowledge or consent and have withdrawn the direct debit again.

My bank had been given details to give to customers if they phoned:

Contact Robert McGimpsey (answerphone funny enough)
    0844 855 7015

    Address for refund requests:
    124 Boulevard Petrusse
    Chapleton Drive
    Luxembourg
    L-2330 KY29BH

Good luck with the refund attempts
  • Hi just after reading all your pieces about this. I have just checked my account online too, and lo and behold there has been £9.99 taken by direct debit also. I cancelled our sub. in June and cancelled the direct debit too and we thought that was the last of them. Then we too got a letter addressed to Mr viewer and no date on it either, and I too am really annoyed that these people have been able to steal this money from our account and it is now called another name. We had cancelled the former d debit and this one is in our account with the new name??????????? I have now cancelled this new one.We are so angry with these people:mad:
