Wedding venue problems - want to cancel.

LOL!! I wish I had the guts to do that!!! That would definitely annoy him, he would probably call the police!! H2B laughed at that and is now talking about standing outside with a banner - trouble is, it is in the middle of nowhere so not many people would see it, only the cows in the field and occasional dog walkers LOL!!0 -
Well, no news over the weekend, I am not expecting any either though!!! If I dont hear from any outside help (watchdog, dom or local radio etc) or the venue for that matter by Saturday then we will be filing the court papers!
I would file the claim asap, as it will take a few days for the claim to be served. Its not alot to do it through the moneyclaimonline website. You can claim the costs to file it online back aswell to the total. This shows that you are real.
I am currently in a case with B&Q, it takes a whilst to get to the claim point. My idea is that you will file the claim, they will acknowledge it and then they will have a futher 28 days to file a defense.
Your claim would go like this i guess..
DRAFT -
"We the claimaint, paid the sum of £5000 to the defenant (Name of defendant), as a deposit for a wedding reception dated (date) at the (venue). The defendant is claiming that payment was not received, nor was any booking made. The defendant refuses to return payment. We are claiming the loss of the deposit".
This is a draft, just made up out of my head..
You would then prepare the case against them, it would include the letters you have sent to them. A copy of the bank statement. This should be the key item here, as the £5000 was taken over the phone. It should of been paid via a PDQ machine, so technically a company and will be shown up on the statement. Im unsure what else you will need. This is all incase you go in front of the judge. Its not like judge judy, but in a small room with no scary people. Just you and the judge.
As they dont know who you are, they will have a job giving a defense.
There are 2 choices..
a) They ignore the claim, you win by default & send in the bailifs.
b) They ackowledge the claim, get a further 28 days to file a defense, then you go to court.
If your in the right, then none of this is scary. Just a lengthy period.

Your best option now is to create a thread further up the forum, asking for help with the small claims court.
I am unsure of a section to start it in. Maybe the debt sections etc.0 -

I know you have contacted Watchdog but I thought you might also want to contact Dominic Littewood of "Don't get done get Dom" and others.

I would defo go down the route of SSAFA or newspaper. Maybe also the OP's MP depending on who they are. My MP is awesome and anything to do with the forces directly or indirectly he's in on and does his best to get results. If OP's MP is any use then could try that to, they usually have journo contacts.Booo!!!0

I've been thinking about this all night. If the venue has any AA or Michelin stars I'd be giving them a ring too because I'm pretty sure they wouldn't want to be associated with a con man like this.
You could always set up a alternative website for them naming and shaming them like CSL haveand also post on every other wedding forum not to use them.
