Has your bank (esp Lloyds) ignored your hardship claim?

we are tring to get back £4300 in bank charges. we get £128 a week income support and got charged £355 in bank charges this month but lloyds say we are not in hardship.can anyone help?regards tats0

Hi - just an update as I've got my bank account on my mind whilst contemplating my 52 Hr working week this week, with nothing to show for it.
I've just totted up the up to date charges from Lloyds TSB, and it's now £1,913.74, and it was £947 in April when I first wrote to them as it had become unmanageble. I understand from reading the forum as closely as possible that Hardship cases are not really being taken seriously, or maybe the definition of Hardship is becoming more difficult to prove?
Lloyds recently replied to say they have taken my hardship claim seriously, but are not obliged to do anything, and to wait until the test case is complete.
I've also noticed over the last few months, charges (DD's) that I was not aware of, for 'Black Horse' of £34.58 per month, so even nore investigation work to do!
Should I be writing back to Lloyds, or a higher power? I can not beleive this is not being taken seriously. I have shown evidence of the fact that charges are leading to more charges, it is the charges that keep me over my limit, I have shown Council tax bailiffs letter, as I can't pay, CC statement (also Lloyds) in collection. They could so easily stop this by an offer of refund or waiver on charges until this vicious circle stops.
Unfortunately - the templates + letters on MSE do not seem to offer further advice, though I'm glad they have taken me thus far. I could do with a nudge in the right direction of where to send my next letter
Bank account still in use - as I don't think I'd get another one due to the mess this ones in.

I to banked with lloyds they were so go to give but never to help when things went wrong they just charged you for the joy of it i have a loan o/d and a mastercard so you can guess the charges prob could have a new car with them.
when i phoned lloyds re charges arrears etc they never updated the info so i always go loads of calls and letters so after going on the this site i played the at there own game for every letter they sent me i sent them a complaints letter back ie poor customers sevices poor payment plans etc
did ask for charges back via hardship was told i not in hardship i just spend to much lol not because most months they took over £200. for bank charges
now after the letters am now on top of all acounts on payment plan for od they also gave me £165. back as a goodwill gesture (my ar--) just to a stop me writing to them roll on when we can claim back mine would be £6000+

Yes I have Council tax arrears, but just making arrangements with Bailiff, and just scraping through,
I can show proof of rent paid on Credit card indicating hardship, as no funds available in bank account at the time.
Credit card bill can not be paid - though they are direct debiting me each month, (= more bank charges) I can ask for all the £12 charges back. I can pay when my priority is NOT bank charge repayments.
Instead of getting into rent arrears and other utility arrears I went out and got another job - it doesn't put me into any credit, but gets the rent paid before bank charges kick in.
the rest of the guidelines of hardship are generally met:
Are items repeatedly being returned unpaid due to lack of available funds?
Yes.
Are you failing to make loan repayments or other commitments?
Yes - can't afford CC payments ( I can reclaim, or request to reclaim any £12 charges)
Do you make frequent credit card cash withdrawals at non-promotional rates?
No, but had to live off CC when couldn't get money out of bank, e.g rent/food
Do you repeatedly exceed your credit card or overdraft limit without agreement?
Every month for about a year.
It then goes on to say that “where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty”.
over 1k in 12 months in bank charges.
- OK - I am writing to them today to include more evidence of hardship. - Most of this, the bank knows, but have told me that they are under no obligation. I will include a new schedule of charges + detailed letter
of why I claim hardship + evidence. and await a reply. Based on that reply, I'll get back to you.

i wrote to abbey claiming financial hardship for around £800 in charges got a letter back saying they would pay £220 into the account & waiver a further £95 pending charges, the bad news my name- address was on the covering letter butttt on the second letter was SOMEONE else`s name address, account number & sort code ! rang abbey about it & it was sent to me in error :eek: nothing to do with my account but mr brown is going to be happy with his payment i suspect. grave error on their behalf what with id fraud being so ripe don't you think ?0

Hi, Ive been posting on another thread about this and have recieved some very helpful advice! But heres my story to add to the hundreds of others!!
Im claiming from lloyds and halifax, I only meet the criteria for not being able to pay cc' s and loans, am on a dmp. But Halifax did not rely to my letter requesting the charges be reassessed, having called them TWICE now Ive just been told they are going to reassess it on 30th Nov (well over a month after I wrote to them).
I am also claiming from lloyds, who wrote me a ltter agreeing I was classed as in hardship and refering me to thier recovery dept, even tho I owe lloyds no money! The initial letter was very clear about the status of my charges claim. After I called them I was told they although they agree I was in hardship they are not paying ANY charges back until the court case verdict including those in severe hardship, basically they will help you if you owe money to them, but if you owe money to anyone else for any other reason forget it. I was also told that the FSA had been and investigated how they were handling complaints and where aware that they were not repaying any charges even under extreme hardship (which I accept mine is not!) and that the FSA were happy with their conduct!0 -

might not help much but have Lloyds offered you the control feature on your acc? I was given it for free for 6mths, bounced dd's will only be £10 and unplanned od is flat fee of £15 instead of £15 and £6 per day...0
