Hi, no it's a live account, with a small overdraft (within the overdraft). The account has been in operation for 10+ years
is the account still incurring charges?

....and you have priority debt arrears(mortgage.rent, council tax, utilities)?
If the answer is yes then complete the moneyadvicetrust I&E form and send it back to them with any notices of arrears.
The argument you need to have on financial hardship is that firstly a lifestyle event happened, ie loss of employment, hours, separation from a partner lead to less income going through the account leading to charges and those charges made the situation worse which meant that priority debts built up. The total you claim is the entirety of the charges you have incurred(financial hardship via the FSA Waiver are charges from July 2001 to present day). However, your cut off point if they offer a refund is the point that the lifestyle event occurred and the charges that you received from that point.
    Does that make sense?

Yes it does, my cousin is in severe financial straits and has just got back from the courts having made an agreement with the judge to save his property. Total stress!

  • The sole response from Lloyds was for them to keep ringing me to arrange a repayment programme for the overdraft I had with them. At the time my property was under a suspended possession order, I was in arrears on the second mortgage and was using my one remaining good credit card to buy groceries; all of which are indicators of hardship.

I qualify as a hardship case and I wrote to Lloyds TSB. Unlike Abbey, who are almost chasing me for my details, Lloyds fob me off with a standard complaints letter. What the letter says is that they will pass it on to another department for follow up & nothing happens. I wrote to them last year AND this year and I have not been asked for my income & expenditure.
Esmerellda, I can categorically say that they have not LOOKED at my complaint yet according to the FSA letter that you quoted.
I also have the correct address because they have replied to me - however, they just say that they have contacted a certain department which will get back to me. Now, unless it takes a year for the department to ask for my details . . .
Just like TheBex, I'm glad to see that it's not just me being fobbed off!

I am owed approx £2500 &£1000 interest, my husband about £300, but we have just received a standard letter to say they can't believe we have had problems etc and they will pass our letters on to another dept to look at within a month kind of standard letter. We both meet the financial hardship definition, so looks like we will have to wait for some time....how annoying!!
