Thanks for the phone number, just been on the phone to a lovely girl but she wouldn't budge, just reeled off the same stuff as in the letters..... agh, I could cry with frustration!
Do you have arrears on priority creditors(mortgage/rent, council tax, utilities)?
are any of the arrears being paid off?

My cousin currently has a financial hardship claim with Lloyds TSB. A reply came in here's some words from their reply:
" Thank you for getting in touch with us. So that we can review the customer's financial circumstances in response to their claim they are in financial hardship or difficulty, please provide us with a completed 'Common Financial Statement' on their behalf as soon as possible. You can get a copy of a Common Financial Statement by visiting Money Advice Trust's website at www.moneyadvicetrust.org Please also include an offer of payment from the customer when you return the form .... (not quite sure what thay mean here?)
In the first step of the test case last year, the judge looked at our current t&c's and decided that unplanned overdraft charges are not penalties. They are however, assessable for fairness. The bank's appealed this part of the decision. On 26th Feb 09 the court of appeal held that these charges were assessable for fairness. The banks are now appealling this decision to the house of lords. "

Hi, I posted a letter reply from Lloyds tsb earlier. In the letter they wrote:
" Please also include an offer of payment from the customer when you return the form .... (not quite sure what thay mean here?) "

Hi guys, havent posted in a while, hope you're all doing good!
A few months back I started the reclaim process with Alliance & Leicester & the Co-op using the templates on this site. After a few letters, the Alliance & Leicester gave me 400 of the £530 that I was claiming as I am claiming Financial Hardship.
However, the Co-op has been an absolute nightmare! I am claiming financial hardship - which is true, I have had to move back with my parents, currently have no transport, have had an overdraft denied (by the Co-op), have had my Co-op credit card 'switched off' & my single biggest expense every month is on credit card payments etc etc.
After filling out the income/expenses form they sent me & the accompanying 3 payslips, credit card statements & bank statements they asked for, they then wrote to me to ask me for them again - it turns out, they had lost them. They then told me that unless I was actually seeking some kind of 'advice' from the bank, that resending the documents was pointless as under NO circumstances will the Co-op even consider refunds of charges. So I didnt bother resending them.
I did send them the final template letter from this site, where it threatens to take the case to the Ombudsmen & they have just replied to me saying :
"It is important to note that under the terms of the FSA waiver, firms have an obligation to address the financial difficulty aspect of relevant charges complaints immediately, although this does not include an obligation to process refunds of charges before the outcome of the test case is known."
My request is therefore on hold. Is there anywhere I can go from here? My charges with the CO-op are over a grand & in my current situation, just getting some of that would be really helpful to me!
It has taken months & months of letters, phone calls & 'lost documents' & I feel like I'm still no closer to actually getting anywhere with this. Is it time to admit defeat with this one or is there anything else I can try?

Hi, no it's a live account, with a small overdraft (within the overdraft). The account has been in operation for 10+ years"onwards & upwards"0
