Leave the bank. Open an account elsewhere (RBS seems quite good for charges ;) ) and make an affordable arrangement to repay the overdraft debt whilst telling them the accounts in dispute and you wish to reclaim your charges.

Vote with your feet and stop the circle before it really snowballs.

  • If you were made bankrupt then unfortunately you cannot include accounts that were part of that bankruptcy. The FSA have no legal rulings as to how they must deal with financial hardship so that is not correct either.
If the accounts with LloydsTSB were not part of the bankruptcy then they are still on the table but I would have said NO based on the fact the account is closed with no monies owed.
Surely, if you have had past current accounts, even if they are closed, you can still claim. I had 3 credit cards in which had been closed approx 2yrs. I got my charges back from them. Whats the difference?

If they were part of the bankruptcy then any claim on them belongs to the OR.

Re LloydsTSB I think Nattie is saying no on financial hardship (as accounts closed and no money is owed to them) but yes to reclaiming the charges but expect to wait for the test case to conclude. (but i havent read back)

I already have got another bank account. i did make an affordable arrangement and i have told them i want my charges back. They said they would stop all interest and charges. then a month later i got a statement with added charges and interest. They broke there agreement so i broke mine and didnt pay. I offered to pay bk my overdraft and no more. They said they will keep adding charges. I said put 10 grand of charges on but you still wont get it. have had enough of Lloyds TSB.

And what do you mean vote with your feet and stop the circle before it really snowballs?

Re bank chargse repayment under hardship rules. Nation wide are also ignoring the directive, I applied under the hardship rules ( claim submited to court in 2008 @ Walsll CC ) After being in touch with Nation wide and the ombudsman:beer: Nationwide credited £200.00 to my account for the time period august to sept2008.:confused:I claimed for all my bank charges totalling £3800.00 inc int,I became incapacitated in Feb 2008 and are still in hardship receiving only incapacity benifit.:embarasse

If they had offered charges back to September 2008 I would have negotiated back to Feb 2008. Nationwide are one of the better ones for explaining their decision, for a change.

I think that is for letters claiming financial hardship??
I can do even better, yesterday I acquired their income and expenditure form. As I cannot upload on MSE it is on the Legal Beagles site:

  • For LloydsTSB I have this information:

"Any letters can be sent to Lloyds TSB, Customer Relations, BX1 1LT

The Monetadvicetrustadvice Income & Expenditure forms are acceptable.

We will always send a letter to acknowledge receipt of a customer complaint within 5 working days and our final response must be issued within 8 weeks. However, we will of course aim to issue our response well within this time period"

I am still clarifying issues with them and it is a bit like pulling teeth out getting info.

  • Lloyds just closed my account without telling me when I am still waiting to get back my fees
  • LLOYDSTSB love to ignore long standing customers. Both myself and husband are now unemployed i am on incapacity benefit and he is on jobseekers (both through redundancy)LLoyds have had our combined wages into current accounts for over 25 years however they chose to ignore our requests for a refund of our bank charges saying that we were no longer customers and then sent us a booklet on how to manage our accounts. They wont even acknowledge we are in hardship. They havn't even sent us a form to fill in for our monthly expenditure. It is just laughable especially as today in the Sun RBS Natwest have said that they are reducing their fees to just £5.
Are LLOYDS just waiting to get enough interest on everyones fees knowing full well they will have to give them back sooner or later. We are still trying to get replies but they ingore us.
