i have food to last 7 days, benefits are not coming as i owe to national insurance, what a mess and im firmly in the squeeze, but the halifax still say no no no.

    halifax owe me £6.000 approx

my apologies but i have a deep hate of these bankers at the halifax plc (public liability conmen)
missed direct debit charges, very odd, theres no pain so how come the big gain,i.e £39.00 for a letter

Ok, I have to assume priority debt arrears(mortgage.rent, council tax, utilities), is that right? Are any of the arrears being paid off?

Did you argue that a lifestyle issue, ie unemployment, loss of hours etc, etc, lead to a lowering of income and then charges which impacted your ability to pay priority debt arrears?

Furthermore, do you not qualify for any other means tested benefits? I would probably speak with the CAB with regards to the benefits issue and housing issue

    First reply!

Lloyds claim they rang me to discuss my income and outgoings, but they really never did, I was at home all the time (unemployed) and never heard the phone without answering it.

I wrote to them with details over a month ago and have no received no response at all.

They were similarly bad at responding to my CC charges reclaim.

Should probably write to them again and ask what's happening... although I don't see them as being likely to respond this time either. Wonder if the use of a highlighter over the words "financial hardship" will help the letter get to the right place?

Thanks MSE team for showing me its not me, its them. :)

Said they phoned me too, but all i got was a call what cut off, when i asked them straight about why they gave me cut off calls they ignored that too and responded "we tried to ccontact you several times"

I still have the letter they sent me, which is basically a lot of verbal avoidance to my questions, my questions were straight up and to the point, their answers were irrelevant, made no sense and were avoiding the questions, like politicians do.

I have tried on numerous occassions by phone and post to try and get LloydsTSB to consider my case under the hardship ruling, to date no joy, they have informed me (without asking for a list of incomings and outgoings) they do not consider me to be a hardship case and that my claim will be placed on hold with all the others. I have now involved the Financial Ombudsman who have written to LloydsTSB but in the meantime they also told me to write to Lloyds myself and enclose a list of incomings and outgoings, which I am in the process of doing, this is so very fustrating and unneccessary.

    Did this to me too.

My claim with Lloyds has been going on over 12 months. I went down the hardship route and Lloyd have never sent me any forms to complete or contacted me about the claim. All I have received is the standard refusal letters due to claims being on hold.
The FSA looked into my claim and were told by LLoyds that they do not feel I am in hardship as I am repaying a loan to Lloyds and have not defaulted on this. The FSA agreed with Lloyds and I have now appealled againt this. Hasn't stopped Lloyds sending me threatening letters about going overdrawn, which I wouldn't have been if they had not charged me so much.
Refused direct debit ? LLoyds charged me £300 on two seperate occassions and £250 on another. Someone is not playing fair and LLoydsTSB seem to have the FSA on their side.

    Sounds farmilliar too.

  • alliance and leicester were ignoring my hardship claim untill the FSO sent them a letter now they are saying thewy are only allowed to repay the last 6 months of charges under the hardship rules which is just 3% of the amount i was claiming
  • I have a hardship claim with Halifax, this has been ongoing for the best part of this year. My first response from them was a standard letter and pegged on the end was an invitation to discuss my finances with their Money Management Team. I received a few calls from this team, always when I was at work. They also failed to call me at the better times we discussed. I then sent another letter thanking Halifax for the help of Money Management however this service was not working and did not address my initial complaint. This game of tennis with these letters has gone on all year and Halifax are just biding their time and also hoping I will drop it. I fit the criteria with priority debts, some of these have a clear papertrail back to excessive bank charges whilst at University. I am now being made redundant this Friday, having been hanging onto my job as long as I could but now the inevitable is happening. I am now forced into writing to Halifax to consider a 25% less settlement, I wouldnt normally but my redundancy does not have a payout and if these bank charges are deamed unfair and compensation/return of charges is on the cards it would really help if they could consider it now.

Why are you writing to them with a 25% less settlement?
Under Financial hardship they can offer £0.00 of the charges. DO NOT negotiate anything that reduces the final amount.
If Halifax have not dealt with your complaint ask the FSA to relook at it.
If you have argued that a lifestyle event lead to less income and then charges leading to priority debt arrears that are not being paid off then argue that point. You total charges back to July 2001 but the financial hardship being as I have suggested. You need to complete and income and expenditure form:
    http://www.bba.org.uk/bba/jsp/polopoly.jsp?d=259&a=3545&view=print
Bottom of the page PDF file Budget Planner.
    Ask for a final response.
Are you repaying any of the arrears off?
