Once more for the hard of reading, It is most certainly NOT a fine. The criteria for a blue badge is very strict, and temporarily being on crutches would not qualify you for one. Whilst I appreciate the area was not busy at that time, if everyone took your attitude it would have caused a problem.
It is up to you if you pay the fine, but in future, just use the spaces that you are entitled to use.
Blue Badge schemes do not apply in Private car parks.
I see my words about moral outrage were prescient.
Once again - morals have nothing at all to do with the legal issues involved.
Do not pay this ticket.0 -
Thanks people, it will be ignored. If it truly is just a scam the correspondence that will follow will be mildly amusing and not intimidating.
And for all it's worth, knowing i didn't put anyone out i think my decision to park there was the correct one.0 -
Buying a CD wasnt a priority that day was it, now really.
Whilst I sympathise with your condition, please do not do it again.
Having said all that - Dont pay the 'invoice' they will eventually get sick of you ignoring them.
How do you know it wasn't a priority? Who are you to tell me what to do i make my own decisions based upon the circumstances.Out of interest how much and to who was the ticket payable. Did it say anything about time limits to pay and follow up actions if not?

Erm... in the case of you being lectured for parking whilst your (able bodied?) partner nipped into the shop... the warden was absolutely right.
The blue badge is for YOUR convenience, not your partner's. Leaving the disabled person in the car whilst an able bodied helper nips off is just as bad as an able bodied person parking in a disabled spot. If it were you going into the pharmacy then you do have a right to use the parking place.

Specifically: "If you have a badge, it must only be used for your benefit. If a trip is for someone else and you are a passenger and staying in the car, you cannot use the badge to let them benefit from free parking."
The warden should have lectured the driver not the passenger, so you are wrong. Passengers are not responsible for driving vehicles last time I looked, maybe on your planet.
Also the prescription could be for the disabled persons benefit so you fail at reading comprehension too.

Agreed. It would seem that some people consider that disabled bays in supermarkets are not necessarily for those that are disabled, but for those that have a BB (which has no legal status on private property).
My advice to those that are temporarily disabled is to park on double yellow lines close to the store. You will still get a ticket, which you can still safely ignore, but will save the rising blood pressure of some posters on this forum.

Have been receiving the usual threats from a private parking company but recently received a solicitors letter, thing is it was sent from the same address in Thornton Heath as the other letters, the solicitor is based in Leeds, could they be passing off? Cheers P0

What do you mean 'could they be passing off?'. Do you mean are they pretending that the letter has come from a solicitor? I hope not, as it is a criminal offence for someone to hold themselves out as a solicitor (not that breaking the law seems to bother these guys).
Whatever, the fact remains that they are unlikely to take you to court - solicitor's letter or not.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Assuming Ephemera has a BB, the trip was for the benefit of the BB holder. In the first instance the trip was necessary to go to GP and the subsequent trip to pharmacist to collect medication. If any of that is in doubt, how did the traffic warden know that she didn't intend to actually go in the pharmasist when, say the prescription was ready rather than stand up on crutches waiting?Erm... in the case of you being lectured for parking whilst your (able bodied?) partner nipped into the shop... the warden was absolutely right.

If you want to play it safe then write a letter back to them saying to cease and desist.
This website is great:

particularly this thread:

Read what it says on the bullet points in particular.
Basically they won't take you to court because they know there's no way in hell the courts would rule in their favour, as the precedent that would set would mean EVERYONE would be stuffed for parking charges all the time!!Trev. Having an out-of-money experience!
C'MON! Let's get this debt sorted!!0 -

Writing to them is not playing it safe. It's playing into their hands, and encouraging them to bother you even more.
And PPCs do win in Court sometimes. However, as these cases only proceed in the County Court, they do not set a precedent.0
