Most of my fears were unfounded, I made it all much worse in my mind than what it turned out to be, and realised that most of the suffering and loss had actually been met on the journey to the bankruptcy. There is a lot of experience to be found on this forum, so see if someone can help you - what are you so scared of?

And I made an error in my dates - my OR interview is for next week, not this week, so a little nervous waiting to be had for a few days yet, but I've sent in all my forms etc now and bank statements so I feel a lot more organised than I was

          3. Hi, people, we went Bankrupt on monday 14 September at 10 am, and had our interviews by phone with the O. R. on friday 25th. My husband had one and a half hour interview included asking about why we raised secured loan about 3 years ago, and what we did with proceeds (debt consolidation!), hadn't got the foggiest as we are badly organised, paper-work nowhere to be found for it. He spent all saturday in deep depression. Still looking now. Worst part is, a letter came today from endowment insurance company, the O R has taken it, and we thought it was linked to the mortgage and safe! So now we don't have life insurance and our negative equity has just increased by about £45,000.
....So, my question is, what happens now if we walk away from the mortgage, give the keys back and move to rented accomodation. Will the mortgage company and secured loan from the bank be included in our bankruptcy?

            Yep. It would.

The mortgage/secured loan company may ask you to sign paperwork to say you are liable for any shortfall, but you simply refuse.

Thanks for the kind welcome (I am so bad at replying as so much has happened in the weeks since my bankruptcy).

I have my interview tomorrow and I am pretty nervous as since my br, I have found a job (brilliant news as I have been unemployed since March) but now really need my car for my work having previously being resigned to handing it back (return of goods order was made the day before my br). All I can do is discuss the position with the OR and see what happens. My new employer knows my full position which is a great relief and they have been incredibly supportive, but the car could potentially cause some issues.

New SOA completed, and to be honest it is barely worth me working from a financial point of view, but it is such a huge lift to be earning the money that keeps the house and family running especially after the last 18 months that have led to this position.

Going to be a very long month before payday, but can't wait until matters start to become clear from the interview and month to month financial position.

On a side note, how uplifting was it to see the October 2009 Bankruptcy thread?? only 10 more to go :):)

Just had the OR interview and didn't realise it until I asked at the end lol :rotfl:ooppss

She was lovely was only on the phone for 15 mins ...... didn't want to speak to hubby either I just had to relay what she said to me to him!! wow... :D

No interest in our car so we get to keep that and our pensions are ok they have no interest in them either the one thing they are keeping is my £5.14 ISA but hey I can live with that!! :j............... as we were on the IVA before and seeked CAB advice they are happy with what was on the form........ OMG I thought I would have to get all my statements debt paperwork etc we both are in shock!! but a good one at that! also no order to pay anything!!

All that happens now is to fill out some paperwork she is sending in a pack in the post and that is us all done and dusted!

            :j:j:j:j:j:j:j:j:j:j:j:j:j:j:j:j:j
