    I received this earlier today.

Thank you for your email. Unfortunately, since your order was placed we have experienced a stock issue with this item with our suppliers.
Therefore, we have had no choice but to discontinue the item you have ordered. Causing the second stock alert you should have received detailing that the item is now "inactive".
Regrettably we will therefore be unable to complete your order as it stands. If you would like to select an alternative product we will be happy to amend your order to reflect the new request. Alternatively, we can arrange for a cancellation and refund of your order.
Once again, please accept our apologies for any inconvenience this unforeseen stock issue may have caused. Please let me know by return of email how you would like to proceed.
    Regards

I emailed and got the following response:
My apologies but the graphics card which you currently become unavailable to us from the supplies because they are unable to meet our demand and as a result from this we are no longer selling this product. We would greatly appreciate an immediate response regarding this matter.
I emailed back saying not a problem, since you've already taken my money just supply me an equivalent or better card instead :D

    I did that too!

    See below...
    Thank you for your reply.
I can confirm that when your order was processed, we were expecting further stocks of this card. Therefore our automated systems processed payment. As detailed in our terms and conditions, all payments are processed immediately.
As soon as we were aware of an issue with the stock we did contact you to advise of the situation. Unfortunately from time to time such stock issues are unavoidable.
I have checked our range of cards and unfortunately we do not stock a similar card within the same price range, therefore we will be unable to offer an equivalent product for the same price. If you would like to amend your order to a different card, I am happy to do so for you, but any difference in price will be payable.
Alternatively, if you would prefer to cancel your order, I will do so as soon as requested. Hopefully this will avoid any interest being charged within you credit card billing period.
Please let me know how you would like to proceed.
    Regards

they are definitely lying about the 'not able to get stock' as other online retailers have them in stock, so if they wanted to sell these they could actually get them for us (if they tried - and they cannot say that they cannot sell an equivalent specced card then - as they are available on the market).

see if it is possible to get a contact for the supplier, and maybe you can chase it up, to ensure they aren't lying!

if only there was someone who lived near ccl so they could inspect the warehouse to make sure they aren't just with-holding stock from us.

Can I claim under "loss of bargain" that they are failing to fulfil a contract and that if I fulfil it elsewhere they will have to pay me the difference? Pretty sure I can but has anyone done this successfully before?

    Just received this by email:
After your order was placed, we received news that we will be unable to source any further stocks of this product and therefore have had no choice but to discontinue the line. As a result we will be unable to complete your order as requested.

Therefore, to avoid any further delays we are now cancelling your order and processing a refund of any monies due back to your card.
Have written back and asked them to pay for me to buy this from somewhere else. Be interesting to see what they say (especially because they cannot source any further stock of an item which has ONLY JUST been released!)

Wrote to the MD Suzanne Isaacs and got this!

Please accept our sincere apologies for the problems you have incurred with your recent order. I am very grateful that you contacted me, we appreciate all customer feedback and take any complaints extremely seriously. I am also grateful that you provided us with an opportunity to explain the factors that have contributed towards your perception of the poor service levels received.

I feel that Andy has adequately communicated and explained the details surrounding the stock shortage and the resulting issues that this caused so I have no further comments to add with regards to the unavailability of the cards you ordered. We endeavor to maintain a consistency of stock across our product lines but occasionally, due to matters out of our control, the supply of an item previously readily available will suddenly cease.

Unfortunately, on this occasion, we are currently unable to source an alternative product, as requested, so I have therefore arranged for both of your orders (711901 & 711498) to be refunded immediately. Accounts have confirmed that that money has been refunded to your card, so as to prevent any further delays.

I apologize if you are unhappy with your shopping experience, however, the stock delay was communicated from the point of order and then as soon as our suppliers confirmed that the card was no longer available. More often than not a suitable alternative is available but in this instance this proved not to be the case therefore a refund was immediately offered. We pride ourselves on providing an efficient and effective customer service but if the perception is that we were trying to somehow hang on to customer funds then I would like to assure you that this was certainly not the case. Many customers do decide to update their order rather than cancel it when a stock shortage is communicated; it is for this reason that orders are left open until customers have had chance to consider their options.

Please accept my apologies once again for any inconvenience caused.

    Regards

    Suzanne

In other words no replacement just a refund.

    What a fanstatic idea !

Create own company on website with non-existent goods which have bargains that r too good to miss, get loads of orders taking credit card payments, keep it in a bank for a month then send everyone their money back and then keep the interest.

Sounds so easy that there MUST be a law against it ?

    If not ! WOOHOO !!

Hmmmmm....... Let's see how long it takes for them to refund everyone's money !
