If this is the case, is anybody considering the possibility of challenging the actual loan itself ie that the loan was in effect missold (is that the right phrase to use?) on the basis that no valuation of property, Pictures advertising at the time, salary checks etc were completed.0

Well done dialysis, as Martin said Picture have nothing to lose from this they are now just a money collection company, but it will be great to have the story out there and make the FSCS see we are still here!DS1 12/10/04

We have had a reply from Martin read it and see what you think.:T:T:D
Its an interesting case - and not sounding good. The problem when looking at any default company is it has no brand or reputation to protect - and the administrators dont care about that either.
This means media pressure has very limited impact. Though I do think it is something we should be looking to do.
I want to do it as a news story and get some research done on it - but itll be next week before that happens because of staff absenses (and Im in the midst of hardcore filming)
We will look at it though.
Martin
Brilliant :T:T:T

I have also been lurking around this thread for a while and am really interested to see that there is a possibility of challenging the selling of the loan. I have always been uneasy about how my loan was sold and I think that this just confirms what I have been thinking.
So to answer the question -yes I am thinking of challenging if I can work out how.And now I'm no longer a lurker but getting involved.:j

Ok, just had phone call from..... my case handler (yay!) She has all the information back from Picture for my claim and is working on it, it then goes back to the FSCS who will check it over and decide if I have a claim for compensation if I do the FSCS send out a letter to confirm this.
The lady said it should not be too long now as they are actually able to work on the claims now. (yay!)
Still confused as to what makes you liable for compensation in the FSCS eyes and if anyone finds that out let me know!
But looking good and so nice to receive confirmation my claim is being worked on and hearing the words not long now from a claims handler!
Keep smiling.xxDS1 12/10/04

Will give further details once I have looked at the paperwork again, and then follow the advice I'll get here for my next step.0
