Neighbour told us to take fence down.

I guess if you really wanted to be petty, do nothing. Let them take it down in 2 weeks and a new fence then put in the correct place.
Once this is done, then go back to your solicitor just to double check. Who knows, they might be wrong after all and have to move a fence!

I guess the problem is that your are moving, and taking any legal action in advance could be dodgy. If you were staying then I think it would be possible to get a court ruling on the ownership to decide it once and for all (or an injunction to prevent them removing/moving the fence?), but that would definitely have to go down as a "neighbour dispute".0

If you look up anything on ROW access you find people that want to restrict access being told that they can't, if its in your deeds then you have right of access to your back garden through the neighbours garden.0

Sorry to keep harping on,now the neighbours have puts lots of patio slabs in front of the gate,to block entrance.Been out them to challenge them,said "unless they can provide all legal wriiten land regstry proof etc of non ROW etc they are not allowed to do this".Phoned solicitor up,he said to take some photos,see him again tomorrow.
The neighbours say " do not know what documents you have,but ours say the ROW is only for 8 & 10"ours say for 4-14,us being no.6.
The neighbour came back at me and said something like "do you know the size of your garden to the centimetre,we do",i said nothing i came in the house and they went in.0 -
i think a nice letter from your solicitor reminding them of the ROW and that legal action will be taken to restore said ROW if not cleared within xxx daysNonny mouse and Proud!!

Just read the whole thread. My word what a saga for 2.5 inches of land running up the side of a garden fence.
I am in the same boat as clutton though. Is it all worth it? If it were me I think I wouldn't have gone as far as you but at the same time they shouldn't get away with it.

Sounds like a nightmare, OP. I don't think it's as simple as backing down and letting them move the fence either. All they have to do is delay moving it for months or years, and you still have an ongoing issue that will delay the sale of your house.
I think you'd be better standing tough and letting the solicitors thrash it out. Do you even know for sure if they have consulted a solicitor about this? So far all you have is talk, and a letter written by themselves. Sounds like a lot of bluster.
They are clearly doing it to devalue your house, or force you into the position of selling to them... nasty.

There are many completely legal ways to annoy the **** out of your neighbours, but I wouldn't suggest doing them if you want to sell. Saying that I wouldn't back down, just let the solicitor do his job.0
