Neighbour told us to take fence down.

We have bought our new house in the Midlands outright with cash(we are not rich,the money was from compensation for our father dying through medical negligence).We were going to move in in a few weeks,and leave this house on the market.Also i have handed in my notice at work and am/was set to leave the end of this month,ready for leaving for our new home.They have really put a spanner in the works.0

i know this will not be a popular suggestion - but you are leaving for a new life, you have had a very sad time with your father;s death - does this Really matter to you ? Let them have it - and then sell the house as quickly as you can and move on ........
you have already incurred solicitors fees - this will go on and on and on....
and no - its not fair - but all this fuss and ongoing stress and court fees for a few inches ?
is it worth it ?
let them move the fence x inches and watch them do it - then move away - future owners wont need to know0 -
clutton's post won't be popular on the basis of "why should they get away with ... blah, blah" but !!!!!! does it matter to you, you won't be there.
Tell them they can move it - the several inches only - at their expense and they must reinstate, fill-in the holes etc left also at their expense.
Then get on with your life where you want to be - as you are well aware, it's far too short to be farting about with loonies like these.0 -

I am even considering bringing in our local newspapers,they have an interest in all these neighbour disputes etc,and it would show everybody how nasty these people are,but we will ask the solicitor Thursday for the go-ahead to do this or not.
I personally wouldn't do something that is clearly going to make matters worse. Some of these disputes can get very unpleasant - taking it to extremes, people have been murdered over disputes that started like this.
Letting them have their way is one option - although I know you shouldn't have to. Sometimes fighting these things, although the right thing to do if you know you're in the right, is just not worth the hassle is it?
If they're so desperate, let them have it as long as they do the work / pay for it. Try and draw up a written agreement in case they try and be clever and take more than their precious 2" :rolleyes:
Then you can sell your house with no known disputes and go and live in the Midlands with a clear conscience and forget about the cretins.
Alternatively, go to court where you can sue them for harrassment, damages, etc. What is their complaint, and what evidence is it based on? They can't just go to court and say you have taken 2" of their garden. They will need to prove it, and I can't see having read through this thread what they base their complaint on. The court will just laugh at them.
If you're going to take the legal route, write down everything that's happended so far, and keep a diary of every conversation you have with your idiot neighbours about this subject. You can use that in your evidence.If you will the end, you must will the means.0 -

However I'd mark off exactly two inches all the way up with string and little stakes and tell them that THEY can move the fence at their own expense and that you'll be supervising to ensure they don't stray over the 2 inches.“Don't do it! The thing that gripes us is that they have owned this property 5 years.But in that time they have been renting it out.Now though,it is the owners grand daughter and boyfriend who rent off her.Why did they not bring this land dispute up sooner,rather than weeks from when we are due to leave,5 years down the line.0
