I strongly suggest you follow the advice of Clutton and subsequent posters - the only winners in this situation are the Solicitors
I suggest you let them have their bit, sell up and move out and move on

As someone at gardenlaw said, perhaps they are trying to !!!!!! up your sale. Perhaps they want it devalued to buy it themselves? The timing is striking.The thing that gripes us is that they have owned this property 5 years.But in that time they have been renting it out.Now though,it is the owners grand daughter and boyfriend who rent off her.Why did they not bring this land dispute up sooner,rather than weeks from when we are due to leave,5 years down the line.0 -

I don't like being blackmailed, which is effectively what the OPs neighbours are trying - get some of his garden or screw up his sale. Whilst I wouldn't stoop to knotweed, you really wouldn't want to **** me off like that as you'd find a nasty suprise to bite your !!! once I'm gone.0 -
We could not give any garden back anyway,we have both a greenhouse and a shed(which has been in that postion over 20 years)nearly flush against the fence,give or take about 6 inches.0

If your shed and greehouse are up against the fence then what do the neighbours propose that you take those down as well???? and if they think it's going to be done as soon as you've gone then they would have to move the greenhouse and shed and in order to do that they'd have to trepass on your land....

doesn't that count as adverse possesion after just 12 years (just going from memory so please correct me if i'm wrong) so even *if* they wanted to try and claim anything from you i think you can tell them to whistle and that you believe they have some of your garden.......
and if it is vexatious litigation i'd go after them for damages once you comprehensively win any court battle.

sorry, but a dispute with neighbours (particularly those as mad as yours sound) would completely put me off buying a house.
That's your problem - it will all have to come out when you sell and if it looks as if there is a continuing dispute with unreasonable people then a buyer will be put off - if you back down gracefully then you can truthfully say that there was an issue but you came to an agreement and the matter is now sorted.RICHARD WEBSTER
