Neighbour told us to take fence down.

We are having a neighbourly dispute,which seems to be escalating.Instead of me repeating myself,is ot ok if i give you a link to the problem,i have already asked elsewhere on another forum,and some of the replies.
I would be very grateful if anyone could offer any form of advice please.

Without some details / photo is is difficult to judge whether or not the fence is in their property or not. I guess you ought to know?
You seem to have the answer you need from your solicitor and quite a few responses on the other site.
I would certainly try my very best to reach an amicable solution before trying to sell. You are oblidged to declare any ongoing dispute with neighbours. Win right thereI suppose you could tell them you will measure, check, and come back to them. Then 10 days later tell them you have checked and established that in fact they have one inch of your garden and you will be moving the fence towards them. Then do nothing.
Also, just explain to the estate agent what has already been said, and give all the evidence like you did to the solictor, if need be let them talk to your solictor nad make sure they dont take the house down.
Also, make sure your neighbour honours her earlier remark of being well off enough to win this with a solicitor. Point out to her that she will need to be to pay for all the fee's on both sides and thank her for paying for yours.Total payment recieved from GPT etc as June: £0.000 -
Personally, I'd tell them "see you in court" then sit back and relax.

Some people have way too much time and money....
It's a piddly bit of land that all you're going to do with it if there is such room is plant a couple of plants whoopee,are their lives so deprived of flowers and greenery that they need every last inch quite literally of "their" land...???
I would cease all contact with these people and leave the communication side with your solicitor.....0 -
You will need to advise any prospective purchaser of the dispute during enquiries before contract. I would be surprised if anyone would buy your property with a dispute of this kind going on.0

I agree with this. Sorry but it would put me off. Once I'd found out what the problem was, I'd realise the neighbours were a complete PITA and not want to live next door to them. Who knows what else they would complain about in the future....Debt at LBM (March 2006): £30,000 :eek:

Thanks for all your replies,even though they are not what we wanted hear.If things were proven for us and wrote down in plain black an white on the house deeds and land registry documents,this would put an end to it,would it.We are seeing our solicitor Thursday,to see if he can go about sorting these out for us.0

sorry, but a dispute with neighbours (particularly those as mad as yours sound) would completely put me off buying a house. How has the 'stolen' garden increased from 2-3 inches to 3 feet or meters?0

You guess is as good as mine,will leave it all in the hands of the solicitors.There goes moving house in 6 weeks,BA----DS,excuse the language.
I am even considering bringing in our local newspapers,they have an interest in all these neighbour disputes etc,and it would show everybody how nasty these people are,but we will ask the solicitor Thursday for the go-ahead to do this or not.0 -
