    I do not defend those who don't bother to understand or comply with the t&c. You are correct about awarding interest - one reason it's not worth the hassle and risk to sue unless you do not pay in full within SOME sort of time. However, to dismiss t&c and say a judge would throw the case out when you aren't complying with them is laughable - especially given that (according to you) you've had no need to defend claims becasue there aren't any. In any event, in that scenario it obviously wouldn't go to court - provided you also paid the court costs of the case having to be brought in the first place - because the cashback claim itself would have been received long before a hearing. I very much doubt any judge would dismiss a claim for such a fee where you hadn't paid on time and then refeused to pay the cost of forcing you to cough up!

    My point is the same as it's always been; are t&c t&c or merely "rules" you can use to your advantage when it suits? Is this a contract or not? The first thing a judge would examine is the t&c!

    As for all these midly concerned customers who have seen fit to ask for your help - perhaps you should be a sign on the front page of your website referring customers with problems to this site so you can help them when all else fails through proper channels. It would be most interesting to see how many of these happy cutsomers you would be able to help then. Have you sorted out Silk yet? Seems he's been waiting... and waiting... and waiting.... after promise... after promise... after promise... on here? Perhaps my highlighting his case will ensure you finally sort it out for him so you can show just how wonderful your company is.
  • I must admit I'm not a fan of cashback because there are some dodgy companies out there. Also, my wife and I lost about £500 of owed cashback when one of them went bust a year or so ago.

    However, it is undoubtedly a way to get a mobile phone contract cheaper if a bit fiddly.

    In fact, my wife is about to send off her first cashback claim to mobiles.co.uk so I'm quite interested in this thread.

    However, I cant help thinking that this fella from mobiles.co.uk has come here and is doing his best to answer questions here and taking a LOT of flak. Come on guys, no-one is forcing him to do this. And are the other cashback companies bothering to have someone answer questions?

    MJ/Quentin both; we're not talking about denied claims, the whole thing here is a confirmed claim and the time it takes the cheque to arrive. so the only reason we're in Judge Hypothetical's court is because a customer decided they waited a few too many days.

    It was resolved last week, and I sorted out suitable compensation for the bad experience Silk had. You must understand that I'm not going to be promoting myself/the company every time I fix something, so if you don't see a resolution then it's not because I'm ignoring the problem.

    Your point being?

    (Bearing in mind that my post was intended to correct the misinformation you posted regarding what would be claimed from the defendant.)

    But on the subject you now raise, you expect us to comply with your conditions and get our claims in on time, so why expect us to wait anything more than a day for our money?

    I can't see a smiley for "scratching my head" but it's needed here.

    I'm not going to give an answer you deem acceptable because we simply don't agree that the time it takes for the cheque to arrive (within reason) isn't part of the T&C.

    We're paying customers money, and this is what the T&Cs are related to. The fact that the cheque, which has been confirmed as being on its way, cannot be instantly summoned out of thin air really isn't something to fall out over?

    If you want to submit a proposal to accelerate the method CPW uses to generate and despatch I'd be happy to look at it. Fact is I've already written just such a proposal and it's being progressed currently (in partnership with E2Save actually). Other than this what is your suggestion?
