By your own admission, you expect that should the 30 days end on a Sunday, you then want reject the claim unless it arrived by the 28th day!

We didn't invent Sundays, or Royal Mail. If we said "32 days" you'd be arguing about day 33 or 34.

Length of time for payment to be received wasn't on the cashback page until I amended it last week, so we've gone from no obligation to a realistic one where delivery of payment is concerned.

The page previously only talked about the timescale for confirming and sending the rebate, which we are well within as you yourself have demonstrated (21 days).

Everything after this point is logistics, and not the basis of an agreement with the customer.

Really, really my final contribution to the cheque-raising debate.

    Regards,

This is completely untrue and exactly why I having been making my comments.

The timsecale WAS clear and on the t&c which YOU choose to call something else - and refuse to accept.

My payments are NOT within 21 days and 21 days was never a t&c. This is a total and utter red herring and absolutely NOTHING to do with the t&c I am on. It is something YOU have added to try to extend payment timescales. You constantly refer to "14" and now "21" days - and have the audacity to declare that "The page previously only talked about the timescale for confirming and sending the rebate". What an absolute LIE!

THIS is what it says on my T&C:-

"Your cheque or payment direct to your bank will be sent" WILL BE SENT!!! "within 30 days of receiving your claim". You are attempting to ADD 14-21 days for some sort of processing or whatever you dream up. When is a complete and bald-faced lie not a lie?? If this isn't perfectly clear then nothing at all is! Of course, these aren't REALLY the "t&c" even though (apart from anything else!) you are instructed "For cashback and discounted line rental T&Cs please click here."

You are the one insisting we do have 30 days to claim.

I am pointing out we do not! And irrespective, Ofcom say your condition is "restrictive".

There is no argument that you have the full 30 days to pay us though!

We approved your claim and requested the cheque 21 days after you sent the claim - from your own post.

You must ensure your claim is with us by day 30. The subtle difference between this and your translation is what's causing the issue here.

Getting really bored with this now.

    We know
    (a) Cashback cheques can take up to 58 days to be sent back. No one has yet said it takes longer.
    (b) That timescale is too long and the mobiles.co.uk rep has conceded that and they are trying to shorten the timescale.
    (c) It was ambiguous before as to how long it would take and the site could be read in such a way that the cheque would arrive in the customer's hands in 30 days.
    (d) The site did not indicate that no mail would be accepted on Saturdays and Sundays. Wording is being changed to cover this. (Better cover bank holidays too, Ben!)
    (e) OP has had his claim accepted and will report when his cheque arrives.
    (f) There still seems to be a gap between what Ben has promised and Silk being sorted out, which doesn't reflect well, I must say, even given a c**k up theory. Ben acknowledges that.
    (g) "Ben" may at a later date become a team, as per the Vodafone Rep on other threads.
    (h) No one has as yet posted that mobiles.co.uk have reneged on their claim, assuming that the OP gets his dues.
    (i) There is some other technical dispute about whether or not the time taken to pay cashback by redemption cheques forms t&c or not. That awaits a court case.

Now - what else is there to discuss?

Not really the full case here.

    1) I'm not responsible for Ofcom, who say your condition is "restrictive", (and want it changing!)

    2) You are the one insisting we do have 30 days in which to submit our claims, I am pointing out this is not so, and definitely doesn't compare with the 30 full days you have to pay us!

"sending" = "will be sent". Seems straightforward to me.

Yes, we all sit around with your confirmed claim in one hand and your cheque in the other, laughing about all the extra pennies we're making, or something. It's nothing to do with needing a secure printer for the thousands of cheques CPW print each week (and the oversight needed to control this), and this printer working to a 14 day turnaround (14 days for the printer + 14 days for 2nd class post = up to 28 days for the cheque to arrive, before you should chase it with us).

    Thanks for your time,

There's YOUR 21 days again. It is not and never was mine. Only you could try to take a simple word like "send" and make it into something different. My T&C state nothing about 21 days or some sort of extra time, or allowing for the machinery of some other body to actually write and post a cheque etc. They simply state quite clearly that YOU will SEND payment WITHIN 30 days. All else is an attempt to ignore the t&c and wriggle out of the fact that not only do you NOT comply with them but you also deny them. You can concoct timesacles of 14 days (by which according to you previously people will have RECEIVED their cheques), 21 days, 22 or 13. Makes no difference to the t&c which I am on and which make zero mention of any of those timescales - whatever you may add afterwards. THAT is renaging on your own t&c and flies absolutley in the face of "we are one of the fairest dealers on the internet"!
