    MJ a few posts back when you replied and disagreed, I never said don't take a copy of the T&C which everyone should do anyway (no-one would buy a house without keeping the contract?) (if they are that, and if they are should the company not legally have a record?). As the rep said this is a contractual issue.

    (i) There is some other technical dispute about whether or not the time taken to pay cashback by redemption cheques forms t&c or not. That awaits a court case.


    Now - what else is there to discuss?
    This is key to this. What I've been suggesting in my past posts is do we risk driving these companies into the ground after (if) finding that this is unlawful practice?

    Isn't a cure for insomnia something that makes you sleep, not keeps you awake?

    True. I acknowledge that.

    It could be argued that I/we drove some dealers into he ground by assisting so many of their customers to actually obtain their cashbacks. In the case of a huge company like cpw there isn't much danger of that. I would like to risk making them actually acknowledge their own t&c and stick to them though - there is absolutely no question (no matter what the rep says) that these ARE t&c and the rep is saying that they aren't - but something entirely different which suits their inability or unwillingness to actually comply with them - whilst APPlying them when it suits to their customers. IF they complied with BOTH sides of their t&c rather than just the ones which suit them I wouldn't take issue. However, it was the rep's initial response to dismiss them and subsequent attempts to re-write them rather than doing so which I really take issue with.

    Whether they are T&C is still an opinion, I do however agree with you though.

    What I meant earlier was that if this is found to be unlawful do we risk making the cashback contracts unprofitable for CPW, therefore resulting in them closing those all down and resorting to just free gifts, etc. Is that what we want?

    Obviously not, I understand that all this is simply picking out problems to try to get your (or client's) money back. Which admittedly I would do too if it came to that.

    MJ, I really don't want to have to keep returning to this issue but this simply isn't true, it's a heavily biased and accusatory account of steps I took to help future customers and relates to the time taken for the cheque to come in the post, not the redemption deal. All cheques take this long to be raised and I'm working to make it faster.

    Please can we agree to disagree, and move on? Almost everybody else who has taken the time to post on this thread would probably thank us.

    We are undertaking a review of our cashback pages at the moment focusing on their useability which I'd be happy to share with you privately, to get your views on it in advance of it going live. I don't think I can say fairer than that?

    This isn't related to cashback claims at all, other than that they're paid by cheque and this takes a certain amount of time. All cheques go this route.

    The claim in question was approved, as was MJ's. I feel I have to point out that redemption deals simply aren't the issue here

    Not sure silk would. He's been having his own battle with you for about as long as our exchanges. Quick - another happy customer just appeared on one of the other threads on your company.

    I would be prepared to offer my opinion IF you acknowledge that t&c ARE t&c. I am not THAT concerned about you re-writing them as such - that is another issue. I am more concerned with the fact that whatever you may write is nonsense unless YOU accept that they ARE t&c. I wouldn't want to be painted as being consulted in some way on t&c which you subsequently claim aren't t&c. I don't think I could be fairer than that?
