Help regarding my right to replace a PS3

    I am sorry to hear of the problems you have been having with your Sony Playstation 3 Console.

    As you point out the Sale of Goods Act can protect you for up to 6 years from the date of purchase (depending on the goods), however after six-months the onus does fall on the consumer to prove that even though the goods were working correctly that the fault has developed through normal use.

    I do fully appreciate how frustrating it must be to be in possession of faulty goods, however unfortunately in this instance Play.com is not able to help with this issue unless you can obtain a fault report that stipulates that the problems with your console are the result of an error with the original manufacture, and not caused by use since the item’s purchase.

    Once again please accept my sincere apologies for any inconvenience you may have been caused in this matter, and thank you for your understanding and valued custom. I understand this is not the solution you wanted, and I regret I could not be of any further help at this time.

    I still don't understand why Play are bothering to entertain the Sale of Goods Act. As they are not a UK company they are not bound by it.

    If it is simply not reading discs any longer, you can simply replace the laser yourself

    The Anti Tamper screw comes out with a bit of aggression, the rest are just phillips head screws and ribbon connectors.

    Nah, laser is fine - its the yellow light of death. I did find a youtube video for an alledged fix, but most seem to say the fix is temporary at best and require the purchase of some hardware (Heat gun?) to do it, so a bit put off by that :(

    They told me to use totalconsolerepair.co.uk. They were good - it was a week between having the console collected and returned

    Dear Sam,

    I have endevoured to find an authorised Playstation 3 repair centre in the UK and have now had it confirmed by Sony that the are no authorised repair centres, nor are they prepared to look at the machine themselves to confirm the fault with the machine was inherent at the time of sale (as obviously they would essentially be admitting liablility themselves...). However, I have been researching repair centres to find a reputable one you would consider accepting a report from and found http://www.totalconsolerepair.co.uk/ who are the largest independent console repair centre in the UK. I have not approached them as yet, as i wanted to confirm you would be prepared to accept a report from them confirming the fault to be inherent or not before sending the console out etc. I would also appreciate it if you could confirm in writing as per our conversation that if the fault is found to be inherent at the time of sale that you will cover the cost of the tests they will be performing (and assosiated postage costs). Obviously if they find the fault was not inherent, I would pay these costs myself.

    I await your confirmation before I approach them.

    Little update:

    HMV have confirmed they are happy to accept a report from total console repair (and pay the associated expenses if the report is not in their favour) and total console repair have confirmed they are able to produce a report. So PS3 will be sent off in tomorrows post.

  • Console sent off this morning with the following letter:
    Sirs,

    I attach to this letter two pages printed from your internet site of the form I filled in online. When it went to the print details screen it crashed so I was unable to print the final page. Hopefully all the information you require is on these two sheets, but if not, please feel free to phone me and I will give you any additional information you need.

    I spoke to someone on the phone about additional request I had regarding a report I need. Basically I am currently in dispute with HMV about who should be paying for these repairs as I believe under the Sale of Goods Act, the machine should be expected to work for a reasonable length of time. As this machine was purchased 2 years and 4 months ago, I felt it was designed to last considerably longer. HMV do agree with this, but require me to prove the fault was inherent with the system and is not a result of accidental damage or normal wear and tear. The person I spoke to said you can normally do these kind of reports and to enclose a letter explaining what I needed.

    I would greatly appreciate written confirmation from you confirming the following key facts:

    1. Was the fault with the machine due to accidental damage?
    2. Was the fault due to normal wear and tear (bearing in mind its age of 2 years 4 months)?
    3. Was the fault inherent in the machine at time of purchase (e.g. Was it the failure of a component that would have normally been expected to last longer than 2 years 4 months)?

    I appreciate this may be beyond your normal remit, so if such a written report attracts any additional cost, please could ring me with the total.

    Regardless of the outcome of the report, I will be paying for the repair and report in full and claiming the money back from HMV if the report goes in my favour.

    Could you also please bear in mind there is a Ghostbusters game trapped inside the machine. I would greatly appreciate this back, as I borrowed it from a friend and have been unable to eject it from the machine due to the fault.
