    Tony 863,

If your grandmother is like most people of her generation, she will be happy with an apology and a nice bunch of flowers.

I would personally write to head office, explaining what happened, and ask them to investigate. If you are unhappy with their response, report it the local council as a health and safety issue. I hope your grandmother recovers quickly.

I'd call tesco's, and discuss your concerns, plus check that the faulty chair has been replaces. I'd have thought they would actually offer you something, but if no, you could ask. I'm pretty sure you'd be given something from them that could go towards her new TV, but I wouldn't be dealing with the accident helplines. You wouldn't be able to claim on her behalf, they'd want to hear from her, and it could well result in a court case. I think going directly to the manager would be the best option.

This is a nasty comment outside the spirit of this forum, the incident was obviously traumatic for this family, and they are considering what to do, as anyone would.

Thankyou for that, it means a lot. I think you are absolutely right. I have just been reading these replies to my wife and she thinks this one suits the best. I will ring the head office tomorrow and see what they say.

At the end of the day, we could go through courts and she could win a few thousand quid in compo, but it will prob be more hassle than its worth. There is no way on God's earth that she could go to court. On the other hand, she will be happy with a bunch of flowers and maybe a voucher for some money off a new TV.

She returned with one that had broken fold down pedals but said not to worry because they had only given her that one temporarily whilst they sorted her out with an electric one.

This may weaken your case as it seems that your wife chose the w/c rather than Tesco simply handing one over. Was there more than one to choose from?

In addition, your wife actually noticed it was damaged, but - again - voluntarily opted to use it anyway.

    Tread carefully.

Good point. I asked her and she said that she asked for a chair and they provided it. When they gave it her, she said thanks and joked that she would be tired pushing her around because she usually uses her motorised one. The customer services woman then said about their own motorised one that they could lend her and said that she would get it her whilst my wife went to get my nan.

I don't really think any of it matters really cause they could fabricate stuff and so could we. That said, it is a very valid point so thank you

That's what I would do as well - it's unlikely that she would have to go to court, but it is a hassle going through the motions of a claim and her age it might not be something she wants to get involved in.

I recently had cause to complain/claim against Tesco for an injury to my hand caused in one of their stores and I accepted £100 in vouchers for a few cuts and scratches. In my experience they are happy to dish out vouchers as of course, you end up spending them there anyway!

Hope she is feeling better now.

Did you take a copy of the accident form? I think its the pink copy for customers. What happens now is that the white copy is sent off to the customer service centre in Dundee (phone 0800 50 55 55). These are now the best people to deal with in this situation as the store aren't allowed to deal with compensation etc, except maybe a small goodwill gesture. That being said, if you came into my store I wouldn't ignore you, I'd try to help by phoning on your behalf and find out info for you if you needed it. If you give them a few days to receive the copy of the accident form, then call the number and ask what happens next, I'm sure someone in the customer service centre will try to help you out.

I don't have a lot of sympathy for the supermarket as I've pointed out faults when visiting supermarkets and they routinely ignore the warnings. A fall for an elderly person can mean the end of independent living so it's a big hazard for them. The last time it took me a concerted effort to get the manager to do something about a pool of water left without attention and it was very popular with elderly people.

Why don't you just wait and see how your Nan recovers? All being well, she won't develop ulcers, and will make a quick recovery.

You are a bit quick off the mark, thinking about compensation already.

terrible thing to happen but it was accident,

Personally i would write to head office of tesco explaining what has happened, why you were visiting the store (to get a BIG EXPENSIVE TOP OF THE RANGE TV) for your nan who is in her 90's. Whilst this was an accident and the tesco store staff were very apoligetic and sympathetic it has left your nan unsure as to whether take legal action or not and she is very distressed and upset about the whole situation as this could have been avoided had the store staff taken due care and diligence regarding the condition of the stores wheelchairs.

You can add extra info but i would say this is your best route and with a bit of luck they should cover the cost of the TV and it will be done much quicker than going to court as has alreeady been said it could take 18 months down that route.

I wish you luck and you should be up for some kind of (compensation isnt the word) but....... ( i dunno but you know what i mean)
Everyones opinion is the most important.....no wonder nothing is ever agreed on.
