About the only thing they have'nt threatened you with is "The Stocks""The Rack" and "Thumbscrews", maybe thats in the next letter.

Yes but its not from Euro Car Parks, it is from a Debt Agency. Although I cant really see how this is a debt, I thought a debt was for something bought or a service used. This is neither. I really dont want to have to appear in court, I am a very shy person

A "debt" agency is just a company or a bunch of private citizens who have no more powers than you or me in law. They cannot blacken your credit record and they cannot enter your house or seize goods.

For that to happen the case has to go to court (very, very unlikely) you have to lose, you refuse to pay whatever the (civil) judge rules you have to pay, and then the court will appoint a bailiff. Note, a debt collector is not the same as a bailiff.

The likelihood of you having to appear in court is the same as you winning the first prize in the lottery. This company is relying on hollow threats which they won't follow up, they would be laughed out of court. Sit tight and keep the faith.

Reading these threads and about how this bully-boy tactics are scaring so many people, I am coming to the conclusion that some of these car-parking companies should be prosecuted for demanding money with menaces.

  • Yes they should, I may as well walk up to people in the street and demand money, its the same principle. It does my head in though I have enough to cope with, without this rubbish !!

Just to reassure you - If in the million to one chance you do have to go to court, don't forget that this is the county court, not a criminal one. It's much more informal . There is no court-room as such. You just sit round a table and discuss the case with the judge who doesn't even wear a wig.

AFAIK its an imformal thing around a table, but as it won't ever get there its not worth stressing over.

Please, please stop obssessing about something that will never happen. That's exactly why they send these letters, to try and intimidate you into paying. Stay firm and they will move on to easier prey.

Just don't worry about it! As I said before it is very, very, very unlikely you will ever appear in court. You might as well make preparations in case you get hit by a meteorite. The odds are that long.
