PCN with Euro Car Parks

Not a real problem just be careful when on forum, eg:- someone parked in a car park, the driver did this and that etc always speak in the third person. He only puts his head above the parapet when he has something to crow about, so we don't see him very often, but he regularly trawls these 3 forums looking for an easy mark.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

It seems this character is something of a one off, at best a maverick. I have found no trace of him making a case against a well armed opponent. I fully expect, based on his 'legal advice', that he would flounder badly in such circumstance.
However the warning is apt, predators always pick on the easiest prey.
Conversely this character will need to take care that he does not pick up a false trail from another more skillful predator that operates higher up in the food chain.0

            Euro are well known.
It's a mail scam. Private companies have no powers to fine anyone.
 • do not pay
 • do not contact them
 • ignore any threatening letters from them. Expect junk from Euro, Brinx and Credit Control
 • they will give up and go away
 • they've never taken anyone to court.0

Can I just calrify does this applies to all PCN's from Euro Car Parks.
There is a multi storey car park near us, and my friend who has a disabled wife, parked near an indoor shop entrance form the c/p. (not in disabled bay).
In a rush, he helped his wife to the shop minding all the cars speeding past. When they came back, he realised that he had forgotten to pay for a pay & display ticket and had a ticket on the windscreen for £50 which will increase to £70.
Should they ignore this as well???0

The chances of Euro going to court are between slim and non existent. If your friend wants to cover his position 100%, he should send Euro a postal order for £1 (or whatever the p&d amount was), that way they have suffered no loss and therefore have no basis for any claim....When they came back, he realised that he had forgotten to pay for a pay & display ticket and had a ticket on the windscreen for £50 which will increase to £70.
Should they ignore this as well???
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0

 Hi
I now have a letter from Control Account Plc giving me 5 days to pay or else they will commence litigation and obtain a judgement against me.
I have not responded to any of Euros letters on advice from kind people on here
 Thanks

You said you've read the other thread, so you've seen all the advice. Why not just follow that advice? The debt collectors have no extra powers.
You've already been told they don't do Court. Even if they do issue proceedings (which they won't) they cannot just obtain a judgment against you without going through the whole court process first.
Calm down. File the letter with the others, and get on with your life.0

I guess I am just skeptical. I have never had any points or anything like that or ever been in trouble and I dont like the idea of being taken to court (if they actually did)
If they do issue proceedings do I have to appear ?0

If they issued proceedings (which I'm 99.9% certain they won't), they will be county court proceedings. You would file a defence to the proceedings, the matter would then be transferred to your local court, and a number of procedural steps would follow. At the final hearing, you just sit in a small room with a Judge who hears both sides of the story.
If they really did go so far as to issue proceedings, with a decent defence, they would have no chance of success.
But it honestly will not come to that.0
