    Had my first letter yesterday from Euro Car parks, now demanding £70. If it is not paid within 14 days, it will be passed to collection agency with added costs.

    You're doing the right thing but just to clarify, there is no debt here - simply an invoice, i.e. a request for payment.

    Not even that. It is just a 'Notice'.

    If it was an an actual invoice the Parking Company would be liable to legal proceedings in my opinion. They would also have to put it on its books as a liability.
    That is not the way they work.

    I have now had another letter from Control Account Plc who have had this from Euro car parks

    The letter says

    It is a legal requirements to send notice of intention to make a civil claim before that claim is issued. This letter fulfils that requriement and has been sent to you at the last address we hold for you.

    This is your final change to prevent Litigation being commenced against you, if you ignore this warning then proceedings may commence and Judgement will be sought. The cost relating blah blah 8%

    It then goes on to say

    If judgement is obtained and an order for payment in full is granted but remains unpaid then enforcement of that Judgement against you may be sought by any or all of the following procedures :-

    Warrant of Execution by Bailiff or Sheriff against goods or assets owned by you either solely or with another (how would this work, would they chop the tv in half !)
    Application for an attachement of earnings (I am unemployed and on JSA)
    Attendance in Court to be orally examined as to your means and assets
    Application for a charge upon property, insurance policies and pension funds etc which may be solely owned or with others


    I am beginning to get a bit concerned now - would it be worth having a free interview with a solicitor ??

    It seems a bit excessive for a £98 quid invoice ! charging orders etc

    What if you dont have anything, or own your own home !

    Judging by the desperation, that letter must be one of the final ones before they decide to leave you alone having realised you're not going to be intimidated with their empty threats and outright lies.

    As Alx*27 says above, Euro Car Parks have never taken anyone to court (even if they did they'd lose) :)

  • Yes but its not from Euro Car Parks, it is from a Debt Agency. Although I cant really see how this is a debt, I thought a debt was for something bought or a service used. This is neither. I really dont want to have to appear in court, I am a very shy person
