Half the time it is paypal who need to put the numpty hat on as sometimes their rules are as clear as mud! Two identical situations can result in two different outcomes, which is why this thread is useful for being able to talk it through and for the rest of us to learn from.

Soo, not new to ebay - and have lots of grey hairs to prove!!
the account that i sold this through has about 70 completed ebay transactions under its belt, so hopefully that will help.
As i said my fear is that if i refund him, he will leave negative feedback saying its a fake, or scud my auction if i relist by emailing bidders saying its a fake....
And it is back to the thing why should i refund when i know its the genuine article bought from the well known and trusted reseller of these items in the uk?

Paypal rarely seem to ask the buyer to prove it is a fake or not, they just find in favour of the buyer in some cases. There have been other threads on here where people have been told just to return the item for a full refund, and other threads where the buyer has been turned down flat, and I can see no logic behind the decisions except for a slight bias towards buyers where a stock item only is shown on the original listings.

Firstly my post you quote was in response to mishkanorman who was not apparently aware of paypal chargebacks, it was not a reference to you being new to ebay.
You really only have two options. firstly to offer a full refund including original postage and hope the buyer is happy with that, or to stick to your guns and fight it out with paypal. If you fight it out you at least have a 50/50 chance of winning and even if you lose you won't be worse off than you would be if you refunded immediately now.

Cheers, well thats my thinking, i must have a 50/50 chance so i may as well let it go to dispute and then only refund if i have to. Hopefully having all the associated documentation will mean they lean in my favour.

My understanding is that if your PAYPAL account is empty the seller will not get the payment even if he wins ! ! ?
I had a recent chargeback when a buyer did not receive goods. I did not contest it but my buyer did not get his funds as my account was empty at the time . I had to load the money into PAYPAL account from my bank account and , eventually , PAYPAL paid my buyer .
This took approx 4 weeks with my full co-operation so if you were less than happy with outcome and had no funds I`m sure you could simply leave your PAYPAL account empty and he`ll never get paid.I`m now officially too old to die young0 -
yeah i've had a similar problem before. i thought they could only do all that with a verified account though? Guess i will find out soon!0

They can't get your bank to do anything. If there's no money then your bank is more likely to simply bounce the request.
