I am in the right - its like someone buying a xbox 360 off you that you have bought from dixons and then demanding a refund as its a fake!
Surely even if i fight him through paypal they might rule in my favour as i have the original invoice for it which i can email to them, i can contact the supplier who will confirm its genuine, and he did receive it as i sent if via SD. at worst if i lose, i will only have to refund, but at least i won't be rolling over and playing dead!
Also, my fear on refunding him is that he could leave me a neg saying its a fake and then i will never sell it because people will read the feedback?
Very curious as to HOW paypal will gather evidence though?0 -

That's because a buyer or seller who is trying to scam someone is hardly going to go to the effort of posting on here about it are they? If the item is fake why would the OP waste their time coming on here griping? Likewise if the roles were reversed and the item were fake it would be the buyer on here, not the seller.0 -
I dont have any experience of ebay, in fact I put my first bid in about 10 mins ago !!, but I have dealt with many an awkward customer .
I would suggest that you dont engage in too much discussion over this as it does appear that all he is after is a reduction in the cost, simply state that it was advertised on Ebay in good faith and although he may feel that you were misleading in your advertisement of the item, it does not mean that it is not in fact a genuine product. He has raised a concern over its originality and you have provided proof beyond dispute that it was purchased from a trusted retailer. advise him that you will not discuss the matter further.
I know its easy for me to say as it isnt my money but I would basically tell him to shove off (as nicely as you can manage), you wont please somebody who has taken such an agressive tone from the start so dont bother to try as often all you give yourself is more trouble.

Ultimately what you are both saying is true though in a way, i've read through old posts where the situation is reversed and people offer reassurances that paypal will automatically refund in the favour of the buyer. Ultimately this item sold for £180 so i can't afford just to do a refund particularly when i know it isn't a fake!0 -

The problem is, and as you are new to ebay you may be unaware of this, is that paypal *might* find in favour of the buyer and chargeback the money anyway. There is also the added complication that if the buyer fails with that there is a possibility if he paid by credit card that he could chargeback through them.
It isn't clear cut which way paypal will jump on this.

With the 'unknown variable' of not knowing which way paypal will jump... I'd be inclined to a) ask for item to be returned b) refund c) claim UID to get your fees back and d) re-sell, hopefully not to another numpty.
Paypal may insist you refund, and there will be nothing you can do to stop that... no matter how right you are.
It's not like you'd lose your £180.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

Not had any dealings of it (thankfully) but i am to believe that if they do find in the favour of the buyer that he will have to return it so that you can refund it (i may be wrong though) and if he refuses to return it then paypal will find in your favour but hopefully ti won't come to that. Good Luck
