    well i've received a call from one of the Beneficial Claims/We fight any claim advisors telling me that as my claim is still with the solicitors - I recevied a letter stating my agreement was unenforceable but nothing since. So technically, they have not said that there is nothing they canb do for me at the moment and are looking to take MBNA to court....and therefore, I am not entitled to a refund until they actually confirm they cannot win this case.

    any suggestions?
  • Dont go with Beneficialclaims, which they are now called WE FIGHT ANYCLAIMS.
    They have distroyed me and my husband, they have put us in £19,000 pounds more debt then ever, they have taken £4000 pounds off our cards to clear these debts, they lied big time, they are a misleading and false just to get you into one of there debt managment programmes once they have tripled your debt.
    I Have now taken it futher with the MOJ who is fully investergation a crimmial affence on what this company has done to me and my family, I have also contacted the BBC news and watchdog and the media about this, my husband has had a breakdown over what they have done to us. I will not stop until i distroy them like they have me and my family, they have caused my husband to have defaults after defaults and has now got to go to county court and may even get a CCJ this is all because of this company. They say they have refunded back the money which i know they have not, I want back all 13x missed payments on all 3 cards and 13x interest back of them as well and the £4000 pounds even compansation for what they have done to us. so I advise anyone NOT TO GO WITH THEM if you have contact the MOJ on 08454506858 and put you complaints in more people do it the more there authorisation code will be removed and they cannot then carry out there work.

  • Sorry to hear your mightmare with above companies. I hope somebody in authority reviews their trading tactics.I am not easily taken in but their fast talking trained staff got me too. They said they could get me back about 13k? re overpaid PPI loans /mortgage payments, I did not beleive that amount but anything would be good as just been made redundant. Said I would have to pay £245 upfront what they actually took was £1960. I asked to cancel immediately in same call they would not. I telphd my bank , the money was taken from my account immediately. I wrote cancelling and put lots of pressure on them,my bank did a sect 75 claim. WFAC kept telph'ing me to rethink,I just stood my ground. I also wrote to Watchdog,tephd Consumer direct and local Trading standards. After 2 months pressure from me with recorded delivery letters/emails to them threatening court action and my bank sect 75, the monies have finally been returned to my bank. The company that holds the money for above companies deducted from you is CTM. Do not give up,I hope someone can help you, maybe Citizens Advice. I wish you luck ,I know how sick you must be feeling

    I too had a bad experience with Beneficial Claims. I too was take for nearly £1,000 but have just managed to get a refund of £600, the second payment I gave to them. I threatened court action and emailed every single day for the last 3 months, hundreds of times on each email, I pestered and pestered, kept on and on at them until eventually received this refund back onto my credit card after a year of stress. I would encourage you to do the same. I told them that I would name the representative who took to money off my card alongside Beneficial Claim, We Fight Any Claim and Yes Loans on the court documentation, I don't know if this did the trick but I HAVE received the money. You much carry on however stressful it maybe, they cannot get away with this.

    From my experience I wasn't actually told that there wasn't anything they could do for me, I waited so long in the end I asked for a refund as a stalemate situation had been reached and nothing was moving. I wasn't getting anywhere with BC, they weren't answering my letters and the endless phonecalls were useless. I threatened Court action and emailed on a daily basis demanding a refund, this went on on a daily basis for 2-3 months, I eventually got £600 refunded to the credit card and have an arrangement set up with them myself. I wouldn't hold your breath, they won't be able to help you and good luck in getting your money back.

The promised me a refund but this took about 3 weeks to finally go back onto the credit card from which it was taken. Keep on and on and on at them, keep mailing them, don't bother posting letters, I posted three and didn't get a reply so I copied the 3 letters onto an email and sent it. I got a reply and each reply for me to them and vice versa the email got longer and longer and longer, perseverance paid off for me in the end, good luck.
  • Thanks to forums like this I narrowly escaped being in the same situation as some of you guys. After an innocent query for a small payday loan online I was called at home by an 0844 premium rate number which dialled to their call centre. After being passed from one person to the next, i was told they could claim a substantial sum of money back for me in "missold PPI's" but declined to inform me of their "fee structure" Only when the battery on my cordless phone started to go did I start to get suspicious. After I hung up I came online to find out some of the horror stories on here. I think it is disgusting the way that Beneficial claims/ wefightanyclaim.com operates preying on the innocent already in financial straits. Good luck to everyone on here in claiming your money back.

    Can I ask whether you had actually received anything from Beneficial Claims/We Fight Any Claim confirming that they could no longer pursue your claim as the agreement was no longer unenforceable or did they refund you the money despite the claim still being with the solicitors

    my problem is that BC keep saying the claim is still with their solicitors and they still believe they can prove the agreement is unenforceable. So if I wanna put a stop to the claim, I am not entitled to a refund as when i signed the agreement, i would only be entitled to a full refund if they could not successfully pursue the claim for me

    sorry just read your post above, I have sent them an email today. I will bombard them with emails until i get a refund, I have told them I dont want any dealing via phone, by email only

    Hi, I have probably come in to this too late to claim back the £1000 taken off my credit cards; I had advice from Citizens Advice on Friday 14th Jan and they advised it probably won't be worth suing them as their name has changed! If only I had looked at this forum earlier!! Is it possible do you think to still lodge a claim and use the term 'formerly trading as Beneficial Claims'?
