I totally agree with you regarding the point that we technically did not win and also that we are entitled to the £80.00 back
My personal opinion is that the threat of a structured claim, by which I mean we:
(a) sent the request for a refund stating 30 days.
(b) sent a "5 day letter" warning of legal action, including advising them that we were going to claim for costs.
(c) we then faxed a copy of the claim to them.
was in some way instrumental in recovering the money we were owed.
However, some times you just quit while your'e ahead...0 -

Some very good stuff on here, I unfortunately got sucked in by Beneficial claims too. At the moment they say my case is still with the solicitors, having already written to me stating the agreement was unenforceable (that was back in Sept 09). Since then I have heard nothing. So I have drafted a letter saying i want a refund and threatened them with a claim through Money Claim Online.
I'm just waiting on a statement from my credit card company that confirms that Beneficial Claims took a payment off there (something they are denying at the moment). Once received, I will send my letter off.
Can I just ask what email address you guys sent your emails to?...shall I deal via email or post?0 -
I did both post and email and never got anything back by post but eventually got Several emails.
Do some letters recorded delivery and keep a copy and the receipt as proof you tried to do your part.

Well today the money arrived in my account, I am glad this is finally over with and I wish to thank everyone on this Forum for their advice especially AppleMac as his advice of using the Money claim online HMCS thing is the best tool to use against Beneficial Claims / We Fight Any Claim etc. to get your money back.Beneficial Claims / We Fight Any Claim / Money Worries / Yes Loans are all the same Scam company.

Registered with Money claim online as can't get hold of this jokers at all !This depsite have a direct phone number and email contact.

Go legal, you have a contract and so can enforce it.
After repeated efforts to recover nearly £3k and being promised a payment by CHAPS (clears instantly into your account) which never arrived, I have used Money Claim on line, HM Courts Service on line version of the "small claims" court to try to get my fees returned. Google Money Claim to get the address.
The cost was £80 but, if I win, I get to recover this plus any interest and will endeavour to place a winding up order on these people as well, simply to stop then doing this to other people.
If you do take this route make sure that you name both Beneficial Claims Limited and We Fight Any Claim Limited to avoid the case being thrown out on a technicality. (See below).
Also, take a look at Companies House web site, they (Beneficial Claims Limited) changed name to We Fight any Claim Limited recently and have claimed exemption from filing returns as a "small business". My feeling is that all those owed money should be using Money Claim to recover their debt quickly, you never know when a company may "run into financial difficulties"...DRAGON LADY0
