    Have just joined the one debt vs 100 days challenge. Target to save £500 in 100 days (just £5 a day for those who are having a day of rest for their brain), in an attempt to make a F&F on one of these pesky debts.

    Thanks Verbatim and dawnybabes. I've just finished a gruellinig 13 hour shift which was madness, so my plan is to concoct some bolshy letters to the creditors on my hitist on Wednesday.

    Sadly there are no jobs closer to home so looks like I will be extreme commuting for at least 18 months to come :)

    Well today is Wednesday, and I'm dedicating the next 2 hours to composing responses to creditors - hope I haven't lost my knack ;)

    Just popped off 2 F&F settlement offers to Next (balance £976 offered £300), and Cahoot (balance £777 offered £260). I am stuck in London again with the bleedin volcano ash cloud and will be working 2 x extra shifts which I expect to pocket £560 from and hope that I could get rid of these 2 debts using that money. I haven't posted my actual letters because I used the standard templates.

    I've given a 14 day time limit on each offer, so will of course keep you all informed. Tomorrow I am devoting to tackling the HBOS credit card hassle which I know they don't have the agreement for ;). Planning to write to them asking for their final response on the matter in order that I may file a complaint with the ombudsman as they continue selling this onto different debt companies.

    Then when I am home on Sunday I plan to make an arrangement to settle the arrears on my AA Visa card with some more "bank" money I should get in the next 2 weeks :). Hopefully if all goes to plan our credit scores should be improved?!

    Any thoughts?

    Gah to being stuck in london and not getting home to family, you must be exhausted, but still extra shifts and extra money is some consolation. I assume no luck with finding work nearer home yet?

    No luck yet Tixy :(, but the silver lining is that there is as much overtime down here as you can throw a stick at which wouldn't be available at home.

    I've drafted a response to Bank of Scotland (I plan to upload their letter to photobucket so you know what I'm responding to!!!), and would be grateful for your thoughts - and anyone else who cares to comment! I'll post the photobucket link with their response separately!

    Dear Mr Ryan,

    ACCOUNT IN DISPUTE.

    Thank you for your letter of 13th January 2010, and I apologise for the delay in my response.

    In particular I wish to address some of the “reasons” you give behind being unable to withhold my complaint. Furthermore I wish to notify you that the account is currently the subject of a complaint being considered by the Financial Ombudsman.

    It is with regret that I must inform you that much of your “explanation” is factually incorrect.

    Your letter refers to correspondence by Ms Ellie Bliss of 20th November. The paragraph in question refers to terms and conditions of an account for which you have been unable to provide a true copy of the consumer credit agreement. As such any terms and conditions are surely not applicable. Unless you are able to provide a true copy of said agreement I am sure that the terms and conditions cannot be upheld? You have shared my personal information with third parties, without being able to provide a true copy of the very document which when signed implies my agreement to such information sharing. You state that Ms Bliss explained in August 2009 that you have in fact sent the relevant documents to demonstrate a fully executed agreement under section 78 of the Consumer Credit Act 1974. However, you do not state what these “documents” are. The only documents I have received from Bank of Scotland, is a photocopy of an application leaflet. You will be aware that this DOES NOT demonstrate a fully executed agreement under the Consumer Credit Act 1974.

    The next paragraph of your response refers to enforcement action. Enforcement action IS NOT permitted while my request under the Consumer Credit Act remains outstanding. As described above, my request has clearly not been satisfied, therefore the remainder of your explanation under this point is redundant and completely non applicable. You refer to a “true copy”, and the fact that a signature box etc may not be included, however you have not provided me with ANY copy of said agreement despite your written assurances that you would. You sent under separate cover a further photocopy of an application form leaflet.

    Therefore you must agree that being unable to provide a copy of the very agreement which implies my consent to sharing of my personal information, means that you are in fact in breach of the Data Protection Act, and I wish to pursue this complaint separately.

    I understand that you have provided your final response on the matter, however I wished to clarify the basis of my complaint to the Financial Ombudsman.
