    Glad Stirling Park have seen sense.

    "I am writing in response to your recent complaint dated 3rd August 2009. Naturally I am concerned that you have found cause for complaint from the outset please accept my apologies for any distress or inconvenience this matter may have caused and for the delay in our response.

    To summarise, you are unhappy with the lack of response to your previous letters. You advise that you have informed us of your financial situation on numerous occasions and do not feel we have assisted you in any way.

    I tried to call you today to discuss this matter further but unfortunately it appears that we do not hold a valid number on our system.

    I am sorry that you have not received any response to previous letters, after investigation it appears that they were received and replies were sent requesting further information. I apologise if you did not receive these.

    If I may explain, I note from the system that you are not paying a consistent amount to the account, this means that the account falls into collections when no payment is received but is then brought back up to date quickly, meaning we have not been able to apply a monthly payment arrangement. At the moment the account is not in arrears and therefore I remain unable to reduce the monthly payments. However, I can see that the account will fall into collections within the next couple of days, at which point I will place notes on the account. I would be grateful if you could forward us on your financial assessment, prepared with the help of CCCS/National Debtline along with a list of all creditors and the amount you are able to pay each month. As soon as we receive this information we will endeavour to apply a reduced payment arrangement.

    I apologise again, blah blah blah."

    I am going to send a response now that I have a complaint reference, and plan to make the following points:

    • I have requested only written communication, so why would you try to contact me by telephone. I will quote the OFT debt collection guidelines which say I am entitled to request communication in any specific medium e.g. in writing.
    • They state they sent replies, when in fact they sent out standardised letters repeatedly sending the same one which did not answer any of the points raised in my communication, and making no reference to my repeated outline of payment offer.
    • They note we are not making consistent payments - since writing to them at the outset, we have made £13.65 by S/O every week since 30th June 2009. Now cancelled as they are in dispute today for not providing enforceable CCA.
    • They state the account falls into arrears and then is brought back up to date. It hasn't been up to date since June. The minimum payment is around £101 and we pay £13.65 each week thereby there is a shortfall each month.
    • Wonder what notes she will put on the account?
    • They request that we send our financial assessment which we have already done, together with a list of creditors (5th copy for them then), and the amount we are able to pay (6th copy of my payment offer).

    So, another letter being sent off. Never mind, I am also sending a notice of dispute as they haven't provided an enforceable CCA:j. Wondering if I should wait until I receive the £560 partial settlement of my bank charges first? Expecting this money any day now...........:confused:

    Just checked Bank of Scotland online - still no £560. I hope it comes in soon because it will repay the older overdraft and we can close that account.

    Have decided its not worth replying to HBOS complaint reply, seeing as I'm just about to send off a default notice :rotfl::rotfl::rotfl::rotfl:.

    Thought I'd save the trees and my energy for the others who no doubt will want to play hard ball.:D

    A post for newly qualified midwives came up in Edinburgh at Simpsons Maternity Unit, so I've applied. The closing date isn't until 25th August, so will wait to hear if I get an interview :D
