    I should point out I am favouring writing this letter instead of the hundred other things I have to do like dry my hair, do some laundry, dishes etc!!!

    I note you have purchased the above account from Barclaycard. Given that we will now be entering into what I suspect will be regular correspondence, I feel it would be appropriate to set out the following terms.


    I would direct you to the OFT Guidelines on Debt Collection (updated October 2011), and would highlight my right to specify how I agree to be contacted in respect of this account. I will correspond with you only in writing whether that be by post or email – I am happy to be contacted either way. I will not be contacted by telephone under any circumstances and request that you remove any contact telephone numbers from your system. I do not wish to make an appointment with any of your representatives and therefore, you will not be permitted to send anyone to my home address or threaten a “home visit”. I would direct you below to the appropriate paragraphs of the OFT guidance quoted.

    [FONT=Times New Roman, serif]I note you have also written to me on 4th October 2011, referring to my request of 16.8.11 for a true copy of the original Consumer Credit Agreement in respect of this account. I have made countless requests to Barclaycard over the last 2 years, and as yet they have been unable to supply a document which satisfies the requirements of a valid CCA. They do however, send on a fairly regular basis a copy of an application form and a current list of T&C's. You will be aware that this does not fulfil the requirements of my request.[/FONT]
    [FONT=Times New Roman, serif]To summarise, I have set out my accepted means of communication between ourselves. On receipt of a true copy of the original Consumer Credit Agreement containing all prescribed terms which make the agreement valid in court, I am happy to enter into an agreement to repay the amount suggested I owe. Until I am in receipt of the documentation which satisfies the above criteria, I will not enter into further correspondence with you.[/FONT]

    Have today received my CCA from Cahoot but not entirely sure its complete. No mention of PPI either including or excluding it. Wonder if I can scan it and upload it for checking? I know the rules have changed and hardly anyone talks of enforceability on here due to that court case, but would really like to know where I stand with this ;).

    OK have looked again and decided that the main prescribed terms (from memory) seem to be there. I reckon a 50% F&F is decent to get rid of this. So I'm off to compose a nice little letter stating the terms I am accepting their F&F on :D.

    Thank you for your recent letter in response to my full and final offer of settlement. I note that you have declined £306.00 as a full and final settlement, however have made a counter offer of £329.24 to settle the account.


    As you did not respond to my original offer within the time frame stipulated, I did (as indicated in my offer), withdraw the settlement offer and used the funds on loan to me to repay another creditor. This means that I am unable to make a lump sum payment of £329.24 but could afford to repay this amount over 12 weeks by standing order at £27.44 per week every Friday. I wish to clarify this is offered as an ex-gratia payment in full and final settlement of the account. This offer is made on the clear understanding that, if accepted, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever, and that I will be released from any liability.


    I also request that, if accepted, you will make an entry with credit reference agency files relating to the above account as having been paid and the account closed.


    I require your written agreement of this offer and schedule of payment within 14 days. I will also require payment details to commence standing order payments. If you do not reply within this timeframe I will withdraw the offer of payment and conclude that you have found this to be unacceptable. Please note without your written agreement of this offer and its terms, payment will not be made.

    Back from McDs and took MIL to Tesco shopping - my halo won't slip at this rate!

    Done a fair bit of housework to keep in hubby's good books and prepared the dinner. Just poured a glass of vino while I print off my letters and make a few phone calls :D.

    I reckon I can lie back and watch x factor tonight with a clear consience given all the hard work I've done today:p. Nothing outstanding or waiting with the ball in my court debt wise as far as I know.

    Only exception is I've received a letter from iQor re: one of the HBOS overdrafts (the biggest one which they have kindly inflated by 100% of charges!:mad:). They are asking why they haven't heard from me:rotfl::rotfl:! Will do the last bit of witty letter writing now (whilst watching TOWIE) and inform them that as they rejected my F&F I can only offer £1 per month token payment. I will then commence token payments and try my luck with another F&F after a while once a couple of the other debts are paid off;).
