We are not talking about a MEF though - MEF ISSUE date would set the effective date, reviews and supersessions are treated differently.0

Yes but a reassessment is an effective date.
Why in one case can an NRP accrue excessive arrears with no knowledge and through no fault of their own when that is not considered acceptable when a case first starts ?0 -

I fully understand that but can i see proof that this is what happened?
request a late appeal on the grounds that the effective date is incorrect. They will need to provide proof that the PWC did request the assessment in the first place. this will help you in two ways firstly if she did not make the request they will need to review the date again in your favour, and two having read the other posts she was on income support at the time and as such the arrears are owed to the government, new legislation is coming out soon that looks at this type of arrears build up. With the right mitigation you should be able to do a deal on the amount to pay back or even better have them written off.0 -
Thanks CMAC.
As i said the csa got my pay detail direct from my employer. They say i earned £70 a week more than i did!Do i sort this out in the appeal?0 -

you not making sence now your original point was a backdated assessment you need to seek a out of date appeal first but yes you could include that point. When did the CSA send you a letter saying the new assesment was done? its this letter you need to work on0 -

CSA use averages over 5 weeks or 2 months. Did you have some extra overtime in the assessment period they may have used?0 -
Yes i did have some overtime but the figures are still miles out.0

I have been paying csa1 since 1999,never missing a payment, for my 1 son. This was £245 per month,30% of my wage.In Nov 08 i was re-assessed for the first time and this was upped to £500 per month.Again just over 30% of my wage.By the time the new level was set i had arrears of £1300 due to the increase. Now this is where it gets messy!
I talked to the ex about coming to a arrangment between ourselves, saying 30% was excessive. Her husband pays half that on csa2 for his child. She said "no chance" and added "I can have it backdated to May 2005 if i want"
By all accounts she asked for a re-assessment then but the csa didnt act on it.If this was the case i very much doubt the ex would of not followed it up at the time. Can i get proof of this request?
The csa got my pay details from my empolyer for 2005 and i sent my housing cost for that time before they assessed me as having none.So the call came yesterday saying i owe £9000 of backpayments,on top of the £1300 i'm paying off because the csa "made a mistake and never acted"!
So for 3 1/2 years i've been living way beyond my financial means without my knowing. As my wage went up i was able to spend more on my son (holidays, day trips),but it was money i didnt have. The csa paperwork confirming this will be with me soon.
If it costs £112 per week to keep my son is itjust up to NRP to pay this?Or does PWC contribute too?
Please feel free to offer any help or advice.0 -
What will a account breakdown show me?
Sorry if that sounds a daft question.0 -
