£11000 arears because csa never acted

Just some details for any of you knowledgeable people who might be able to help.
I have been paying csa1 since 1999,never missing a payment, for my 1 son. This was £245 per month,30% of my wage.In Nov 08 i was re-assessed for the first time and this was upped to £500 per month.Again just over 30% of my wage.By the time the new level was set i had arrears of £1300 due to the increase. Now this is where it gets messy!
I talked to the ex about coming to a arrangment between ourselves, saying 30% was excessive. Her husband pays half that on csa2 for his child. She said "no chance" and added "I can have it backdated to May 2005 if i want"
By all accounts she asked for a re-assessment then but the csa didnt act on it.If this was the case i very much doubt the ex would of not followed it up at the time. Can i get proof of this request?
The csa got my pay details from my empolyer for 2005 and i sent my housing cost for that time before they assessed me as having none.So the call came yesterday saying i owe £9000 of backpayments,on top of the £1300 i'm paying off because the csa "made a mistake and never acted"!
So for 3 1/2 years i've been living way beyond my financial means without my knowing. As my wage went up i was able to spend more on my son (holidays, day trips),but it was money i didnt have. The csa paperwork confirming this will be with me soon.
If it costs £112 per week to keep my son is itjust up to NRP to pay this?Or does PWC contribute too?
Please feel free to offer any help or advice.

Bloody hell!!!
I am sure in there amongst all of this there is a great big fat appeal!!!
If PWC rang the CSA and requested a reassesment and they did not act upon it until 2008!! NO WAY, NO WAY.
That request in 2005 would not still stand three years later the idiots.
Get on the phone today requesting an appeal from....email their enquiry line with your name, DOB, NI number stating that you have just rang requesting an appeal form and that the e-mail is a confirmition of that call.
Cover your back always.
As soon as you receive their breakdown (or what ever they decide to send you) start writing up why you are appealing.
Do a seperate complaint letter about the way your case has been dealt with since XYZ...dont just do an appeal at this stage, do both.
Deadbeatdadsassociation.co.uk has some free advice on there.
Remember to keep copies of everything, record telephone conversations and sent everything via recorded delivery.
Never ever deal of give them any details over the phone....at this stage if they try to call you..tell them that they will have to put it in writing.
You will need records of everything.
I am so mad for you...once again CSA think they can just please themselves for a big fat bonus!!!!:mad:0 -
CSA seem to be doing this all the time , too reach targets. My case closed 2005, yet I get a letter passed onto me in 2008. The first one of its kind in 10 years.
I've not heard anything since my solictor took up the case, last contact was March this year, even though I was unware they got Liability Order in December 2008 and found out by coincidence from a friend who had been receiving the letters prior to the LO being served0 -
If the request for a revision was made in the correct fashion and it is outstanding regardless of the time that has passed it still stands and can be backdated.0

"If the request for a revision was made in the correct fashion and it is outstanding regardless of the time that has passed it still stands and can be backdated "
I fully understand that but can i see proof that this is what happened?0 -
you can write and request you WHOLE file...it should have the call logs and everything. CSA workers have to fill a call log sheet in, they have to keep them on file...this is why we record all our conversations with them.
They have on so many occasions turned around and denied all knowlege of a call!!!
I will dig out the details for you of where you have to write to get your file.0 -
Thanks plinky1 but i've already got my file notes. All infomation from the ex is blanked out.Nothing to be seen about her contacting the csa in May 2005.0

well if there is nothing there saying she contacted them, then they dont have a leg to stand on...0

But as i say all infomation regarding the ex is blanked out.Only shows my dealings with the csa.0

When my partner was told that he owed bout £100 in a missing payment - apparently at the start of the CSA payments, he requested details of exactly what it related to and proof that it was due. They flatly refused to give him any information and said it was up to him to prove that he didn't owe it.
He tried and tried to get details of what was due and what he'd paid so he make sure it was correct but again they said they didn't have to give any details to him.
In the end he paid it because it was only £100 and didn't want the hassle of them chasing all the time, and wasting his money on phone calls to them. I know this is nowhere near what they're saying you owe, but if you are entitled to all your file, don't be fobbed off like my partner was with silly excuses.
Good luck - I know so many women out there really have to fight for money for their kids because the dads don't want to know, but it's so sad when the men that are willing to pay and support their kids are tarred with the same brush. If the request still stands then 3yrs is a ridiculous amount of time to sort it and the CSA really shouldn't be allowed to do this.
I thought 4 months for my partners re-assessment was a disgrace.0 -
was it your DPA print you requested?0
