    From what I understand (although I've not been down this route so don't know!) - once something gets passed to a debt collector, it is actually far easier to negotiate than with the original creditor.

    In my experience this is absolutely the case and Hypno is good to point it out :T

    When I started paying off my debts I was £10k+ in the hole, unemployed and unemployable after graduating with an English degree, no ability to sell myself to employers and a patchy employment history of crummy jobs.

    I was terrified that debt collectors would be effectively the end of the road for me and that they'd run me into the ground. All in all, however poor their customer service skills are, they were definitely the lesser of two evils. I've had two 'phone calls, one letter and two texts in 5 years of dealing with the dreaded debt collectors, which is hardly the end of the world.

    I'm sure that you can get on top of this and will become a proud 'long termer' who sorts things out in the not too distant future :j

    If you don't mind me asking, did you come to a reasonable arrangement of monthly payments with them? At the moment my monthly offers are tiny but hope to increase them when I get a job, but even then the amounts won't be huge (3 years of self-employment has not helped me gain much clobber for a well paid job!) In my mind (bit more positive thinking) I'm thinking that they might just be grateful for getting paid something...?!

    [STRIKE]1. List 34 items on Ebay I have pics for[/STRIKE] Done already-yay!
    2. Take pics of more Ebay items to sell
    3. Sort overflowing Debt Folder into smaller, more managable ones
    4. Clear backroom so I can see the floor again :o
    5. Take garden rubbish to the tip so I can see the grass again :o
    6. Finish painting the living room
    7. Put together basic mini brochure to start selling my crafty wares again

    Need to add a number 8. Talk to OH about my debts. He knows vaguely in a round about sort of way but he doesn't know the extent and actually the effect it is having on me. It's draining enough without having to pretend that you're not drained 27/7! Subconsciously forgot that one as it's the one I am least looking forward to!

    Barclaycard have cashed my £1 token payment. No correspondence as to any form of agreement from them still but it looks better for me that I've made a gesture of payment. :cool:

    Ooh and I'm up to date with all my correspondence, balls are all over in the creditors courts. Scarily looking forward to a good sorting out of THE DEBT FOLDER over the weekend, I want to start getting my cotton wool brain back to the land of the living!

    Looking through as the dust settles on the constant 'troublesome' creditors, there are a few that I haven't heard from for some time, which worries me. I hadn't heard from the supplier that issued the stat demand out of the blue until they showed up on my doorstep. Calm before the storm?? :confused:

    Fine line of do I be proactive and give them a nudge or not remind them unneccessarily that I'm still here!! I have been proactive with the unavoidable ones today - business rates and business rent, especially as it is the outcome of the landlord to pursue me for the rent for the 18 months left on the lease which may make my BR decision final. I've not heard from them since my letter to them at the beginning of May.

    hi Rainy sounds like your facing up to everything and trying to stay positive as possible. Seem to be getting some good advice from hypno and rog... At least you are taking proactive steps... Ebay is good too - as if there is any risk of bankruptcy you may as well get good values from your goods rather than them being taken and sold for token amounts...

    hope you manage to find a positive way through this all soon.

    :hello: Hi savingholmes, you're right, these forums are really supportive. They are my only outlet as no one knows the situation I'm in.

    Which obviously leads to the fact that I bok bok bok bok chickened out of talking to OH over the weekend :o:naughty: :mad:

    I didn't see him much on Saturday but I could've done it yesterday. He wasn't in a great mood but I know that I could be waiting for that illusive 'right time' for ever and a day. :rolleyes:

    Didn't over perform on my list either...

    I do not like half finished jobs, makes more of a mess of things than non-started ones! Plus then all the next lot of jobs get added on and the list quickly becomes never ending. Therefor, no new list until this one is completed!

    Just an update of where my debts are at the moment as I sort through THE DEBT FOLDER :eek:


    1 Lloyds TSB Personal Loan £7878 -Accepted £1 monthly payment for 6 months (ends 12/09)
    2 Alliance and Leicester PL £7465 - Accepted £1 monthly payment for 1 month. (Ended. Have sent 2nd monthly payment as no response to end of 1 month term.)
    3 The AA PL £7600 - Accepted £1 monthly payment for 3 months. (ends 09/09)
    4 M&S CC £3047 - Accepted £1 Monthly payment for 3 months (ends 09/09)
    5 Haliax CC £3200 - Accepted £1 monthly payment for 3 months (ends 08/09)
    6 Lloyds TSB CC £2920 - Not accepting payment agreement at present
    7 Barclaycard CC £2200 - Not accepting payment agreement but have cashed my £1 token payment. Handed over to Debt Collection Agency.
    8 Sainsbury's CC £1900 - Accepted £1 monthly payment for 3 months (ends 09/09)
    9 Lloyds TSB Business Overdraft £10,350 - Handed over to Debt Collection Agency. Not accepting payment agreement at present.
    10 Trade Supplier 1 £6280 - issued Statutory Demand. Have responded with proof of my efforts to come to agreement and willingness to pay. No response. 18 days up 23/07/09.
    11 Trade Supplier 2 £6260 - with third party but not a DCA. No response to paymant agreement as yet.
    12 Trade Supplier 3 £2520 - with third party but not a DCA. No response to paymant agreement as yet.
    13 Business Rates (liable on now-empty business property) £7200 - No response to paymant agreement as yet.
    14 Rent (liable on now-empty business property til end of lease 08/2010) £31,500 - With their solicitors. No response to paymant agreement as yet.

    Other smaller creditors dealt with as and when they rear their ugly heads!! :cool:

    So, all I need to do is get my head round this lot...hmm :rolleyes:

    I'm hoping that if I can get the majority to agree to a short term £1 token payment, I can sort a proper DMP out and join the long haulers. There is an awful lot to tackle though *dizzy feeling* _pale_

    I have spoken to the CCCS about BR and they gave me thinking time on a possible IVA but I have decided through careful research that I don't think an IVA is the solution for me, for various reasons.

    I also found out, which I didn't realise, is that if the stat demand issued against me goes on to them petitioning BR, I can actually defend it in court. I thought it was cut and dried as soon as they hit the big red button. My case is very unlikly a successful one but the CCCS advisor did point out that my creditors would barely get a bean through BR and my willingness to pay from the beginning, their lack of contact etc looks good for me. I doubt I'll have a battle in me if it comes to that. I can just see a Rainy shape curling up hedgehog style!
