    Well I lost BUT although they acknowledged my letter of complaint I then heard nothing. Didn't actually realise how much time had passed then got a demand for loads of money as it had been unpaid! Wrote back saying they hadn't replied to my appeal AT ALL other than acknowledging that they had received it and got a reply saying I could pay the £35 as their original refusal letter to me hadn't arrived. So a small victory there. Paid online this morning.
    I have LOTS of nice photos of my little jalopy now! :rotfl:

    UPDATE

    As you may recall I based my claim on the fact that the situation of the car park itself and the designated disabled spaces within it suggested that they were for the offices (Mon-Fri) and ineffective at the weekend, as I had been told by a traffic warden, prior to Park Smarter taking over the car park monitoring hereabouts.

    But I paid up.

    Then I had cause to check the council website on an unrelated matter and found that there was information posted on car parking.

    It says HERE that the Car Park in question HAS NO PROVISION (ie no designated spaces) for Blue Badge holders.

    So I wrote to them asking for a refund - I have today received a letter in which they accept my argument and I shall be refunded!

    (I also suggested they make sure all their operatives are aware that there are no designated disabled spaces in this car park!)

    It has made my day - not so much the money but the fact that I WAS RIGHT!

    Quite tempted to try it again and 'interfere' with their system! I feel all anarchic!

  • Well done Valli! I remind me of when I got a ticket through the post and I knew 100% that I'd paid and displayed. I appealed - but the only evidence I had was a blank ticket! Either the sun had bleached the ticket (it was a very hot summer and the ticket was in full sun all day while I was at work) or it had come out blank and I hadn't noticed as was in a rush.

    Anyway, I sent the letter and the blank ticket and I won!! I was totally surprised but very pleased!

    It really is worth appealing, even if you think you've only got a snowballs chance! Congratulations on your victory!

  • Its the councils fault for using tickets which bleach in the sun. Congrats on the win. I wonder how many more just paid up even if the ticket is illegible.
