Since I have been advised by a parking enforcement officer that these disabled spaces ‘don’t apply’ on a Saturday I believe that I should not pay this penalty charge.

    What does the signage say.

Your ticket must be issued in accordance with the signage regardless of what anyone tells you.

BTW, the ticket office only have your word that you were advised by a parking enforcement officer.

I will check on saturday -

I know they've only got my word but that's often what it comes down to in court - the jury has to decide who is credible so it's worth a try. I am not lying about what was said and I had parked there before...but it'll be interesting to see what happens...it's only the cost of a stamp and a letter so worth a go I think...

I was making an analogy - in a court case it can often be one person's word against another. Much as in this case. I say I have previously been told that the disabled sign did not apply. They might say I am lying. They might believe me much as a credible witness might be believed. I did not say there would be a jury in THIS case - just making the comparison.

Understood. Small claims is 'the balance of probabilities'. Appearances and being genuine count for a lot.

AFAICR all civil court is 'the balance of probabilities' [not just Small Claims track].

Mostly. It depends of the nature of the charges. The 'burden' can differ.

Gosh is this going to develop into a discussion about the legal system?
    That'll be interesting...
