The second of those links is actually very helpful because it gives some advice on what to say to your credit card company when you ring them. I will send it both to my bank and to the ASA and see how they respond.

I emailed photobucket yesterday to complain about the ads they are still running, I got this response:

Thank you for submitting your information. I will forward your comments alongfor review and consideration. We will have someone look into this further.Sincerely,Your Photobucket Support Team
  • I was inveigled into this because I was emailed by an associate of the scam company promising me freelance writing work if I reviewed this product.

Although I cancelled quickly I have had various charges on my CapOne CC, as per "standard operating procedure" for this company:mad:

I looked up the Fraud Act 2006 and it says (section 2)

    Fraud by false representation

    (1) A person is in breach of this section if he—
    (a) dishonestly makes a false representation, and
    (b) intends, by making the representation—
    (i) to make a gain for himself or another, or
(ii) to cause loss to another or to expose another to a risk of loss.
    (2) A representation is false if—
    (a) it is untrue or misleading, and
    (b) the person making it knows that it is, or might be, untrue or misleading.
    (3) “Representation” means any representation as to fact or law, including a representation as to the state of mind of—
    (a) the person making the representation, or
    (b) any other person.
    (4) A representation may be express or implied.
    (5) For the purposes of this section a representation may be regarded as made if it (or anything implying it) is submitted in any form to any system or device designed to receive, convey or respond to communications (with or without human intervention).

The person who emailed me clearly contravened this act. So I phoned the police and after some insistence, got a crime number. I went back to Capital One who weren't being that helpful. They explained that I had to go back to the companies and ask for a refund.

I phoned all the phone nos and they have been disconnected and the site acaislimplus.com has disappeared.

CapOne are sending me a disput form. They seemed more amenable this time - perhaps they have had a lot of complaints. Basically I think having to do chargebacks actually hits their business model so they might be inclined to cut off the merchants as Visa did? If we all complained to the head office of our credit cards maybe that would also be a way to get back at them?
  • I too found Capital one very unhelpful, everytime I asked for help or a suggestion they just read a script, that did not even address my questions. Anyway after a 20 year relationship we have parted ways:p
    LBM- finally kicked in 16/12/08 @ [strike]£41,862 [/strike] £0.00/ DFD- 24/12/13 :D

  • Yes me too just realised over £120 taken from my account.

Thet have started a new product Bromacleanse same scam look at the terms.

Tell everyone you know. on face book and email etc

I am part of the law on the internet...I am the spelling and grammar police!!!!

Try 'their name', and 'who is' or 'who's'....and some capitals and punctuation.
  • Hi i just cancelled my RBS debit (visa) card on the phone, however I have been reading about payments/transactions still going through?
Can anyone provide me with a valid telephone number I can contact them on to cancel my 'subscription'? I'm utterly gutted about this as they've taken £60 from me and I'm a student who needs that money to eat... Like I've said I cancelled the card I used and have another on the way but was wondering if I have to close the bank completely in order to terminate ALL other fraudulant transactions (other people talked about other companies billing them for products they didn't suscribe to)
Am finding this a really hard moment, as I've never had this kind of problem before and I simply cannot afford the debt to pay off... ANY help regarding cancellations/contact details would be hugely appreciated, or just any help in general. Thanks in advance, Matt.
