What he means is by suing is, if winning B&Q will have to pay the difference between what they didn't supply to what the cost is of purchasing elsewhere (Loss of Bargain) - hence you will have the opportunity to gain the water tank (or similar) at the original cost of the B&Q sale deal.

Good luck to you all - I thought about buying a tank...not because I needed it or wanted it, but because I could almost 'see' the outcome, ie no tanks, money taken, money refunded, sue B&Q and profit. I decided not to order because whilst I am the first to take advantage of low prices/misprices etc. it has to be for something I need or really want but up to the point of any lower price offer being posted I felt I couldn't justify the cost.

I seriously wonder how many who ordered this item 'genuinely' wanted the tank (or tanks for those who ordered multiply quantities) and will, if they win a small claim, go and buy one elsewhere with the money......and how many will pocket the 'profit' and rub their hands with glee and await the next error on a website.

Don't get me wrong....B&Q asked for everything they are likely to get, their T&Cs are ridiculous - more so in view of the fact that following the dishwasher fiasco they didn't bother to change them and their money collection procedures to protect themselves and their suppliers appropriately.

I do really want the tank - I don't have any mains water near the barn where I keep my horses, so I collect the water off the barn roof. I currently use a 1000 litre IBC tank for the water, but there's no pump or anything with it so the hosepipe from it is just gravity-fed, the water discolours and goes green as it's a white plastic container, and there's no filter or anything to stop the dirt off the roof going into the tank. So yes, I do have a genuine want/need for this tank, and what's frustrated me is that I had several days of being excited about how much easier it was going to make my life before B&Q let me down.

I would be chuffed to bits if they would instead supply the 900 litre flat sided tank that someone else referred to on the last page, but unfortunately it looks like that is out of stock too

I've asked via email if they could supply me with a comparable item - I don't want a refund??

TBH, it's the start of a "paper trail" to try and sort this matter. If taking this further you would need to show you tried to resolve this amicably.
