I would hardly think that not retracking bonus points is an error on Tescos part. They must know and choose not to take them back, they never take points back when you get a refund. Nor do I think the onus is on the customer to point it out.

All Tesco require when you ask for a refund is that you provide the receipt. It's up to them to check whether you've had any special offers etc. I bet if you told the assistant about the bonus points he/she wouldn't have any idea how to take them back. You'll probably be hauled off to CS while they phone Head Office because no one has ever done that before!

Does anyone know the correct legal position here?

Yes you do get 999 points for each iPod you buy in the same transaction.
