    I think I'd be a bit suspicious too. 3rd in chain is better than a cash buyer? Solicitor has worked out the mystery buyers true position on Monday when offer was made over the weekend? It's only Tuesday!

    I'd be trying to get proper clarification here. If you are still interested in house 1, I'd ask your solicitor to give their solicitor a call and find out exactly what is going on - if you're going to get an honest answer, your best bet has got to be the solicitor over the vendor or the EA.

    silvercar, reading back over your posts, it's sounding like the gazump was a double bluff that has backfired on the EA because you weren't bluffing. Was the house 1 being marketed at £10k more than you were purchasing it for?

    it seems a bit convenient that the *first people* shown the house after your withdrawal make a *cash offer* of *£10k more*. If you are 3rd in your chain, we are clearly not talking FTB property here. A buyer like that is, frankly, gold dust.

    You've broken their chain and the people further up may now be threatening to pull out, which gives some reason for the solicitor to think that you are in the better position because you've got so far, but you've still got 3 links of the chain to catch up with you. I can't see the logic at all, even at a matched price, unless these new buyers don't exist or aren't in such a good position.

    But i'm a cynic!

    I reckon they have messed you around enough and it's time to walk away!

    Things happen for a reason.

    However it does depend on how much you want this house, I wish you luck in your decision.

    Angel, you are so right we should just walk away.

    The appearance of this buyer is a mystery but I do know someone pulled out of a house in the next road at a similar price last week due to a dodgy survey. It could be true, though I think the cash buyer thing was an exageration - "under offer but I may do a BTL and not sell" maybe more accurate.

    The point is we have completed all the legal work, have mortgage offer and survey done. This other guy hasn't. Also the woman further up the chain is still keeping everyone waiting so in a months time he'll have finished his survey / mortgage etc and our chain aims to be ready. Effectively in a months time we could both be ready, so I guess the vendor's are feeling guilty and saying if we match the other guy's price we can still have it.

    Have reached a decision --ish.

    If I get a phone call today with the details of the solicitor for house 2, we are telling house 1 where to go. We made the offer 4 months ago, they accepted, either they stick by that or they can get lost. I'm not playing these games or there's the risk that they'll ask for more money just prior to exchange.

    If the vendor was feeling guilty, then why was they still accepting other viewings and offers?
    A bargain is only a bargain if you would have brought it anyway!

    OK EA on house 2 has phoned to say he has the solicitor's details.

    House 2 here we go!

    Not actually going to phone house 1 as I don't want to speak to them after the way they have treated us.

    For what its worth, I think you have made the right decision. I also think Doozergirl is spot on with her summing up of the position.
