maybe the landlord just wants his money to pay the mortgage. There is no fault with that. None of us would work for no wages cause we wouldnt be able to pay our mortgages and it isnt his fault that the tenant is a plonker.0

Nobody is disputing the landlord should get the money back, not at all. But they've really left themselves open to this by not taking a deposit and letting the arrears get so high before doing anything about it. Hopefully now they'll be a lot more careful in the future.:heart: Think happy & you'll be happy :heart:

you can get your benefit paid into any bank account you choose and well then that brilliant for the op
Not sure what you mean - but a tenant cannot choose to have their LHA paid to the LL.
If the tenant does default it is up to the LL to provide evidence and an investigation takes place - and based on that the Local Auth can choose to pay the LL - in most cases 8 weeks arrears or more guarantees the LL gets paid directly0 -

When I filled my form in for housing benefit, it asked me if I wanted the money paid to me or to the LL? If fact as Rob says, you can give any bank account that you want.:heart: Think happy & you'll be happy :heart:

Housing Benefit or Local Housing Allowance - 2 very different things and 2 very different sets of rules:
How is LHA Paid?
Changes and effects of LHA. The major change and effects of LHA is that LHA will be paid direct to the claimant. Therefore it is the tenant’s responsibility to pay the rent to their landlord.
In recognition that some tenants may struggle with the responsibility of paying their rent, safeguards have been put in place.
Payments may be made to a landlord when:- There are arrears of 8 weeks or more
- The local authority considers it is improbable that the claimant will pay their rent, i.e. the local authority is aware that the tenant has consistently failed to pay the rent on past occasions without good reason
- The claimant is deemed unable to manage their own affairs. Please refer to our ‘Safeguard Policy’.
Local Housing Allowance - Safeguard Policy
Under Local Housing Allowance (LHA) a tenant cannot simply request that payment is made to their landlord. Direct payment will only be made to landlords for vulnerable tenants. This policy sets out the guidelines by which officers will make decisions on vulnerability and has been developed in consultation with stakeholders.
Furthermore just giving them the LL's bank details and saying they are their own will not work either.0
