Health care professionals and the Social services (and therefore their fraud division) work together to ensure you are recieving the correct benefits for your situation.

If them answering questions is deemed to be against your human rights then we'd never catch anyone on the fiddle. Or are you saying the health care professional has reported you for "being on the fiddle"? in which case surely they would be treated as a general member of the public reporting possible fraud, and an investigation would be launched as you would expect.

If you are in receipt of or have applied for DLA haven't you already signed the end paragraph which says something along the lines of 'giving permission to your records' I know the wording isn't 100% accurate but its something along those lines.....and if you have - yes they can do this - are you worried they will stop your DLA if they think or are told your health is improving?? I'm trying to help you here but you have worded the question so strangely.

    A last attempt:

If I have proof that a member of staff in the clinic has contacted authorities and informed them about my presence in the treatment room, which is public, does this in your opinion constitute a gross breach of privacy law and human rights or not?'

pls only answers to this question!

    thanks

It's more likely the authorities contacting the clinic and yes, the clinic is obliged to tell them. It is not against your human rights to have checks done on your benefits. Of course it isn't!

If somebody suspects you of commiting fraud then they have every right to contact DWP & inform them. Indeed, DWP is encouraging people to report anybody they know or suspect of commiting benefit fraud.

DWP have powers to investigate anybody they think may be commiting benefit fraud, which is as it should be. Privacy law doesn't come into it. If you are claiming a state benefit then the state reserves the right to ensure you are a genuine claimant.

The real question is, as others have mentioned is do you have anything to hide? If not, why are you so hung up on it?
The bigger the bargain, the better I feel.

I should mention that there's only one of me, don't confuse me with others of the same name.

My fairly rudimentary knowledge of the Human Rights Act leads me to think that this scenario does not breach any rights - particularly Article 8 (right to privacy) has a fairly broad interpretation. Case law relating to Article 8 generally refers to telephone tapping and extreme police surveillance - not really what is described above. If it is worrying though, contact the police.

Here the question: If I have proof that a third person 'in the clinic but not in the treatment room' was involved informing the authorities of my presence in the clinice, do you think this is legal or do you agree with me that this constitutes a serious violation of my human rights? Since I am acccused of something to someone else who has nothing to do with the investigation?'

Yes of course it's legal, we're all encouraged to report benefit fraud.

You will be logged on the computer system as having treatment with the clinic.Obviously the DHSS has access to this. They will video you entering and leaving the clinic as part of their investigation.Other than that i would say you are a paranoid schizophrenic.

where I do medical and health treatments' to watch my 'agility'.

It sounds like someone may have made a claim to the DHSS that you are more able to move about than you make out so they will follow you and like i said before video you to prove if this is true.It is only right that they do this to stop people fiddling benefits for things like disability.

Is it just me, or is the OP actually just visiting a gym, perhaps with a physio/ OT/ trainer? I am intrigued as to what the 'treatment room is a space the public can use when needed, thus, open to the public' is! :p
