    Agree with the above points.

    Moreover, if I apply for a job and get a job where my job description & job title are the same as other people in the same company, I can negotiate whatever salary I wish for a huge variety of reasons. This can be done regardless of any experience or whatever else somebody may argue entitles them to higher earnings.

    In fact a huge number of things could be a factor here:

    1. Employer urgently needs another employee, but can only find one suitable candidate at the time. This candidate may be able to negotiate a better salary for him/herself regardless of their experience.

    2. Employee may live a long distance away from the workplace and argue that they would only take the job if their salary reflected their travel costs.

    3. Times can get better or worse for a company throughout time and at one point in time they may be offering better or worse salaries to the same job level.

    etc, etc.

    What bothers me is that a lot of people spout absolute nonsense with the whole aura of being an all-knowing deity. Would you have called it Sex Discrimination if the sexes were reversed? Just because in this case the woman is the lower paid does not necesserily mean that the REASON she is lower paid is because she is a woman.

    Despite having followed and read the entire thread, I do not wish to take sides as I do not know the precise detail and have only heard one side of the story. If Hedger's wife has indeed been discrimated based on her sex, I wish her every success in putting this right. Without hearing both sides of the story and considering all relevant evidence, I cannot make any kind of judgement on this issue.

    However, I just do not buy ill-informed arguments (not of the OP, but of a number of other followers) along the lines of...

    X is paid more than Y. X owns two pets, Y owns none. X is a blonde & Y is a brunette. Some of the above posters would very quickly deduce that the employer HAS TO BE discrimatory against pet owners and brunettes on the basis of this evidence.

    Thank God most tribunals have reasonable members otherwise every other wrongful dismissal (females) would be acts of sexual discrimination...

    Personally I think this has developed into a wrongful dismissal issue rather than anything else. The ex-boss speaking to the current employers was never a clever idea.

    But the whole issue of equal pay is widely misunderstood & some of the posters on here just go to prove it.

    Just to shout my support for your equal pay claim! Hope the tribunal in May goes in your favour. As unfortunate as the circumstances are this article makes for a very good read, and also shines as a testament to the MSE forum section.

    Personally I think your case is now less on Equal pay and more on the firms utter failure to apply any resonable process, but I doubt this ruling will do the company any favours in a general sense Hedger.
