JSA claims taking 6 weeks?

    Yes but if you care to read back they have assessed my claim as a couple my partner is self employed as a result we do not qualify for JSA(C) hence we get £27 a week whereas if I claim on my own then I would qualify for the full £64.30

    What you can do is claim the contribution based element and concede the existence of a material fact that would cause you to not be entitled to the income based element. You don't have to state what the fact is, just acknowledge that it exists.

    The legislation allows what you say for ESA (the benefit, not you:D) but not JSA.
    If by 'concede the existence of a material fact' you mean that the claimant can tick the 'Contributions Only' box then we are in agreement. The claim is assessed as JSA(C) in the first instance - only six months down the line does the JSA(IB) become a concern.

    If you were entitled to JSA(C) then it would be paid at £64.30 regardless of the Income Based part of the claim only being £27 a week. The higher amount is paid.

    Again, I don't understand - my apologies. It is the ib element that would be affected by your partner. If you qualify for the conributory element she could win the lottery (as could you) and it wouldn't matter.

    And you will not recieve more money from the contributory element than the incom based element. No way, no how.

    Yes, ticking that box is such a concession. I believe the box should not exist, and neither should the option in the new computer system they use.

    People don't understand they are making that concession.

    Some dont but most do when it is explained to them. What is the point of someone whose wife works 40 hours a week claiming JSA(IB)?

    As I explained as a couple because partner is self employed and earns NOTHING as a couple we are not entitled to contributions based AT ALL (no NICs) but however I have been employed continuously for over 15 years so I do qualify for it so as has been mentioned previously in the thread I need to make a single claim rather than as a couple as I should then qualify for it.

    btw our income is CTC and WTC only so please dont anyone get on their high horses about us having plenty of money coming in, i'm only wanting to claim what i've already paid for and am entitled to

    All sorted now got my MP onto the case and they sorted it in 48 hours so should now be getting the full £64.30 per week for 6 months.

    Oh this wasnt helped by HMRC cocking up my employment record and losing my NIC payments for the whole tax year of 2007
