    As previously noted, s.75 Consumer Credit Act doesn't apply, but that doesn't mean you have no recourse. Your contract is with hungryhorse. Write to them, Recorded Delivery, and demand a full refund. Use this template. If they don't pay up, take them to court. If it was really that bad, it might be worth doing this. At worst, you lose the court fees.

    Please accept my apologies for this confusion. I have just chased this up with the restaurant, but they believe that the only phone call they received about this order was from me - when I asked the manager to give you a call back. So it seems like either the person who took your call had left for the night, or the phone was put down accidentally on you.

    In any event, I have asked our accounts management team to follow up with the restaurant manager on Monday, because what you have described sounds to me like an unacceptable level of customer service from the restaurant, and we do need to investigate. Please accept my apologies for the poor experience you had tonight.

    Unfortunately, the restaurant manager has not consented to a refund. I did try to persuade him, but he feels this is a matter of personal taste, and it is not his policy to grant refunds where a customer simply did not like the food. If you would like to try calling again, I think he would be happy to discuss this with you in more detail. He was grateful for the feedback, and disappointed to hear you didn't enjoy the food, but at this stage he is not willing to refund your payment.

    As a gesture of apology for the disappointing experience you had with this order, I would like to offer you £5 off your next online order. I'm really sorry I wasn't able to get you the full refund you wanted.

    Thanks for ordering at hungryhouse. I hope you've managed to have a relaxing evening despite this problem.

    I can't see how taking them to court would work anyway. Whether the food is any good or not is subjective, surely?
  • If this actually occurred in the restaurant itself, I'd have got the refund. If my guests and I found the food so foul that we simply couldn't eat it, I betcha they'd either refund us or at the very least offer us something else to eat.

    I could take them to court for murder and theft. They've murdered my appetite and stolen my desire to order takeaway again in the future!
