Hubby took the card out many moons ago in an airport!! He had ticked no to the PPI but they charged for it anyway. At one point i'd noticed and they were asked to cancel it and refund. They refused to do the latter but did cancel it. After all the hooha about PPI it seemed worth trying to reclaim again. Their reason for refusal has been that hubby agreed to it on the 'phone(which hubby can't remember doing) but they had no proof anyway.
FOS have not been happy with them and it's gone all the way to the top ombudsman. Many letters have been written to counteract MBNA's desperate attempt to wriggle out of it. When MBNA sent the account to a debt collector in the middle of the process, FOS were made aware of hubby's struggle with depression and the impact it was all having. Again FOS were great and ordered them to recall the account, as well as pay compensation for the distress.
It was worth persevering and thank goodness for FOS, as i think this would have ended up in court otherwise.
Well done for persevering with it. I find the worst thing in situations like this is the feeling of powerlessness. You can write them a letter and it often feels like they are replying to a different letter from the one you sent.0 -
