Guys im so worried i can hardly sleep, i received a letter yesterday from bank of ireland stating that as they have not received any satisfactory payments from me that they are passing the account to their solicitors to issue bankruptcy or judgement proceedings and that it is in my interests to contact them within 7 days wat should i do.
Hi Louise
I've not been here very long and my advice is very sketchy, but I'm sure one of the older members will put me right if it's wrongbut....
are you doing your DMP with CCCS or Payplan? If so I would contact them first thing and ask their advice.
Reading through posts it seems that creditors will do and say anything to get us to 'pay more' and people have put in previous posts that once they have got over the initial shock and re-read the correspondance it is usually full of 'we may' and 'it could'.
Sorry I can't be of much help but hope it may be enough until someone more in the know comes along.Slimming World Newby 75.5lbs for starters, another 75lbs after that!:rotfl:One small step for me one giant leap for my backside!;):rotfl:

Good afternoon guys, I would put smilies in my posts but for some reason it doesn't put them in when i click on them! if anyone knows the reason why, would be great to know : )
Anyway I did post last night stating that this weekend was going to be debt free, BUT i got a letter this morning from Santander, regarding my Dorrthy Perkins account, it states that they won't accept the reduced payments because there has been recent spending on the account, which yes i must admit i did use the account in April. so just wondering what could i do in this case? the reduced payments are £5 whereas i normaly pay £8, would it be worth me writing them a letter stating that it will be reviewed and is likely i can afford more in a few months (i do get a pay raise in July)?
or can i pay an extra £3 to them or to do this would i have to increase my payments to all creditors?
Your advice as always much appreciated : ) xx
Hi
As I keep saying I'm new to this so will try and help!!!
From reading others posts and a conversation I had with CCCS I think they do eventually accept the payments after a couple of months, (or pass it to a DCA, which from what I can make out seems to be the best thing as there is more chance of interest and charges being stopped:T)
It may be worth giving CCCS or payplan a ring tomorrow to double check!
I think if you start paying them extra then you are giving them preferential treatment and your other creditors may expect extra too.
I have spending and balance transfer's within the last couple of months on all my CC's so not sure what my creditors will say once my DMP goes through!!
Hope this has helped a little and hope the older members will put me right if not.

hi, hmmm Dotty P's - that used to be GE Money didn't it?
Here's my experience with GE.
They wrote to say they don't accept because of recent spending (I bought food and petrol on my debenhams credit card). I wrote back saying they would continue to receive my payment from CCCS as that was worked out to be a fair proportion to each of my creditors.
Then they wrote to say they accepted CCCS' proposals and would stop interest after receiving the second DMP payment
Then they replied to my letter and wrote to say they didn't know anything about the DMP and hadn't heard from CCCS.
So I wrote a letter back to the department who accepted and said I was extremely confused by their letter from the other department.... they did accept and stop interest
The departments don't speak to each other
So
1. Don't pay any extra - it's not fair on other creditors.
2. Give them a bit of time to see actual payments and they will likely change their mind.
3. If your minimum payment is £8 I'm guessing your debt isn't that much with them - well it costs them over £500 (I think) to make you bankrupt, and I think there is a minimum amount you have to owe that one creditor before they can bankrupt you.... so is it likely to be just a scare tacticMost likely!
4. If any CCJ was issued, the DMP company would reduce your DMP payment to make sure you could cover the CCJ - so no major worries.
If worried, just drop CCCS a line, but I wouldn't lose too much sleep over themworking on clearing the clutterDo I want the stuff or the space?0 -
muddles mess - thank you, you're advice is very welcome and helpful : )newlywed - Thank you too, that's great to here. I think I'm just worrying a little too much about every single letter i get, instead of waiting a while to see what happens, i haven't even paid my fist payment via cccs yet! think I'll drop them al ittle letter as you say and wait to see what happens when they start to receive my payments. ; ) Thank you guys.DMP Mutual Support Thread Member No 315Married 03/04/2010with many thanks to MSE Wedding boardLO 23/03/12 Special thanks to TTC thread0

Help need urgently!!!
Received court papers today from Irwin Mitchell re a debt that has been passed to them by CCCS. I had previously requested that RBS provide me with signed credit agreements to support this debt but they have not done so. The loan was only taken out (under pressure from their collection centre to consolidate my debt at a higher interest rate than previously!!) in October last year.
My question is how do I stop the court action?DMP mutual support thread member: 256
Unsecured debt: Feb 2009 £61,000
Debt free date: Mar 2015...hopefully sooner. :j0
