Hi all, I read this thread daily but not posted for a while as things, I thought, have been ticking along nicely, just into my 3rd month of my DMP with CCCS. Anyhow, hubby has received a letter today from AA Personal Finance to say they will be calling at our home on 11th November and gave a no to ring if this is not convenient. OH has rung the number and been told that they have not received any payments from us!!!! I have my statements from CCCS that show the 2 payments we have made since starting the DMP on 1st Sept but the guy insists they haven't had anything. I've tried ringing CCCS and can't get through, I'm seriously panicking now, I thought things were going too well. Can anyone help or advise? I don't know what I'll do if they turn up on the doorstep.LBM 22/7/2009

hey all
geofmr1 - really gives me hope!! your advice needed.... (oh great one!!)
i have requested my cca off lloyds (CCA= Consumer Credit Agreement) and y/day recd a letter which enclosed a copy of ''my opriginal agreement'' - err can't be as it was addressed at my address now & i took the cc out in 1990 at a completley different address!!!
then lloyds got snotty in the letter saying THEY WILL NOT CORRESPOND ANY FURTHER IN THIS MATTER & basically they have complied with the 1974 act and they don't have to send a copy of the original SIGNED agreement.
What do i do now!??
I want to carry on paying them via the DMP - i just don't want them to take me to court / charging orders etc.:eek:
shall i send the standard letter back which is on here somewhere or go for a more personal tact??
anyhoo - hope all having lovely afternoons - am planning on doing all my xams shopping this w/end - have budgeted & have a complete list & will not deviate from that!!

They will continue correspondence with you otherwise they won't get paid.
They have to send you a true copy of your original agreement (it doesn't have to include your signature to comply). I would let them know that what you have received does not comply, but under no circumstances tell them about the address situation because they'll change it. What they are producing now is fraudulent if it has the wrong address & they are trying to pass it off as the original.
If they want to play silly !!!!!!s thats their choice but if they take it to court with an agreement based on the wrong address they will get laughed out the place.

If you have access to a fax machine or scanner then scan the statements you receive from CCCS showing payments made to AA Personal Finance. Do a covering letter explaining the payments have been made & that under no circumstances is a doorstep collector or agent of any type allowed to step foot on your property. If they do so they'll be trespassing & the police will be notified (should they come round which I highly doubt, phone the police & make a complaint about aggrevated trespass which is a criminal matter).:j DMP mutual support thread member - 135:j0 -

Remember these companies are slower than the tortoise in that famous fable! Their left hands certainly dont know what their right hands are doing. When you pay in one end it may be a completely different part of the country that is ringing or writing to you to tell you they have had no money from you. Unless CCCS have the wrong account numbers (which I very much doubt) then its their paperwork that is not up to date.
Dont let anyone come into your property at all costs, dont even answer the door. you have the proof you have paid, you can sleep at night knowing you are biding by the contract you made. Dont let them bully or frighten you, dont let them intimidate you either. You are in the right and they are in the wrong, the very wrong!! you might find little miss smith has been off sick this week and your postings to your account from the lump sum with references numbers from CCCS has not been processed yet and Mr grumpy is "just doing his job" by writing rubbish letters.
Stand your ground, fax, scan, email whatever you can to the company and tell them to do one.

Thanx for your replies, I feel a little calmer now. OH has spoken to AA again in the last hour as I was in a right state. They have now decided that they have received the last 2 payments made via the CCCS but have not yet received a proposal from CCCS which they have agreed to! Apparently the fact that they are receiveng payments means nothing as they have not agreed to anything. Seems they are changing their story and trying to be as awkward as possible. I still can't get hold of CCCS by phone so have e-mailed them to request they resend the proposal to AA.:mad:

One thing is for certain, whilst getting into debt will always be a big regret for me, dealing with it along with all the consequences has really made me grow as a person.

I think what you say is so true. Some of us know you've had a particularly rocky road to travel and you seem to have coped with all your stress and problems so well. And always you are ready to pass on your calm and knowledgeable wisdom when we need it. Thanks!
Although I am fairly new to the DMP I've been living the budget since April and I know that I too have grown in confidence and have learnt to see the wheat from the chaff.
Maybe this is the silver lining of the DMP cloud for us all?0 -

Copy the Statements and send to AA Personal Finance ( remove any info you dont want them to have ) and remind them that they are obliged to deal with your 'recognised 3rd Party' and not to keep contacting you directly. Also they have to make an appointment at a time of your choosing, not offer you a default time which makes it look more threatening, as in 'we are going to come round your house unless you phone us'...OFT Giuidelines cover this, it is an 'unfair' practice.
Email CCCS and put them in the picture, they are under extreme pressure on the phones.:D stay wonky

Sending just a Copy of an Application Form and Terms and Conditions that would have been in place at the, theoretical, opening of the Account is a feeble attempt of getting around the Section 78CCA request.
They would claim that using the Consumer Credit ( Copy Documents and Cancellations) Amendments of 1983 this would comply with your request......it doesnt. Send them a Default Notice for failing to supply a CCA. They wouldnt be able to turn up in Court with some blank papers and claim it proved your debt:D stay wonky
