    I emailed them to tell them that it had been added to our DMP and that CCCS would be in touch but have had no reply yet.

    Hi Suze72,

    They cannot get a charging order until they have successfully gained a CCJ & forthwith judgement (forthwith judgement means that they are trying to reclaim all the money in one lump sum). If you have no grounds to fight the CCJ then that is all be done via post.

    A charging order can be done by post but in all honesty its pretty essential to go to court if it ever gets to that stage. You would need to speak to the Judge on the day to get certain conditions put in such as interest is stopped, that they accept your DMP payment until the debt is paid & also that there will not try to get a forced order of sale. If you're just accepting of the charge (which I wouldn't recommend but its each to their own) then it's possible you could get them to agree those terms themselves & put it in writing, you would just need to forward a copy to the court (incase they accidentally forget......amazing how often that happens) & that would then all be concluded by post.

    Our DMP is just starting, we are paying £350 per month to our creditors. It's a low start DMP though so it is intended that the payments will rise. This is because we currently pay an extra £50 per month to our secured loan, and an extra £75 per month to our mortgage as we are clearing arrears but once these arrears are cleared (6 months) the amounts will return to normal and the extra will go on the DMP. The secured loan will be paid off in two years so that will be another £222 to go to the DMP every month. OH also gets a raise (£60 per month) every Jan, that will go on the DMP too. Slowly, but surely we'll get there....I hope :rotfl:

    We are paying £1003 per month ( our previous outgoings to bills alone that are now on DMP was £900!!) So some of the creditors are getting more than usual (Halifax £461 instead of £401) but they are still hounding us and we were up to date with it all as well! Really annoyed today that we left ourselves with no emergency funds either :mad:s

    Hi we will start paying next month £469 and we are on a low start DMP too. We wont be upping ours by much at the moment though, once we can change tariff on our 24month o2 contract that will be an extra £20, then we need to change our Mortgage assurance and critical life cover which will be another £30ish pounds, and then DH can earn good overtime but its not definite each month, so we plan to put some aside for emergencies in the next coming months and then out the rest into the DMP.

    I have some news, CCCS sent out all their letters etc to creditors last week and the 1st one I heard from was MBNA, who were a real pain a few months ago when I contacted them, so much so the person on the phone had me in tears and I asked to speak to his manager! Anyway they've accepted DMP and stopped interest, charges etc I am absolutely amazed :T. But then the next letter was for DH from MBNA (sent the same day, who owes MBNA £1K where I owe them 5K) saying if you do not contact us in 7days we will send this onto our solictors to start CCJ proceedings! MAD, MAD & MAD! ANyway I spoke to cccs to ask whether we should contact MBNA to explain DMP, but was advised to leave it as it can take a bit of time fr everything to filter through and different depts dont always talk to each other. DH has gone to work in foul mood, I wonder if he would be better talking to mbna anyway, just to put his mind at rest that he has informed them and not ignored the letter, as long as he is strong enough not to give in and pay them any extra.

    What do you think?

    Sorry for the ramble, but I still feel quite excited that at least one company and the one I never expected to have stopped charges!

    Hiya All ive only just discoved this thread so was lookin 4 some advice, I recently hasd my lightbulb moment following months of sleepless nights and hiding post !Ive missed credit card payments since july and have had daily letters and constant phone calls from 8am-9pm 7 days a wk !, Ive been intouch with CCCS who have advised a DMP which should have us debt free in 4yrs which on paper sounds to good to be true ?, Ive got the paperwork & statements etc signed sittin infront of me ready to send but have a few doubts , Ive recieved a phone call from Natwest 1 of my cc, who have said if i start a payment plan with them it will protect my credit file is this true as im pretty sure they have already defaulted me (i recieved a letter sayin this) ?? also MBNA have also offered me a 0% offer of £152p/m for 5 yrs stain also it would protect my credit file ( amasing as they bumped interest up to 34% & have added nearly £900 in charges over past 6mnths !!) so now im all confused as to the DMP ?? are they just sayin these things 2 keep me from startin the DMP ? also im thinkin of trying to claim charges back frm cc's am i allowed to do this if on a payment plan or DMP ?

    Hi Jayneben,

    To be honest you haven't actually given enough information on here for anyone to be able to say whether a DMP would be best for you. It depends on several factors such as the amount of creditors you have, the amount of genuine spare cash you have each month & so on.

    If you have numerous creditors & cannot afford to keep up the minimum payments then a DMP is probably your best bet. There is little point agreeing to Natwest or MBNA's plan unless you can afford to do the same with every other creditor because they would ruin your credit file anyway.

    Really you need to speak with either CCCS/Payplan or the National Debtline (they would be my choice as they tend to give the best advice), go through with them the creditors you have & the amount of spare money you'd have available & they'll be able to work out for you what sort of payments your creditors will get. That should give you a better idea of the route to take.

    Regarding what MBNA & Natwest are telling you about protecting your credit file, technically they're not lying, even if Natwest had defaulted you previously they can withdraw that default from your file. Personally though, if you're in a position where you cannot afford your monthly payments its extremely likely that your credit file will be ruined by one or more creditors so I wouldn't make that a big consideration in your decision of whether to go on a DMP or not.

    I don't want to burst your bubble regarding MBNA but can I just sound a note of caution.

    They were the first one to accept my DMP (via the phone), I owed them the grand total of £355 when my DMP started in 2007. Well I had a review with the CCCS a few weeks ago & they asked me to get updated balances for all my creditors. You can imagine my shock on friday when I phoned MBNA to get my balance, expecting it to be somewhere in the region of £195 only to be told my balance had now risen to £1237!! I told the woman on the phone she had made a mistake but she wouldn't have any of it, she was actually very rude & despite wanting to speak to the manager I have been passed around from pillar to post with no success so far. It's their tuff luck now though as I'm not paying another penny until they can justify to me that my balance has risen that much, I even have a statement from July 2007 that says my balance then was £264, I accept a further missed payment after that time pushed it up to £355 but that new amount is ridiculous.

    All I'll say is make sure you have it in writing that the charges & interest will be stopped, if you already have it then thats great, if you don't then get in touch with them. See if they are willing to put it in writing & if not, why not!!

  • Well I had a rare afternoon off today so I rolled my sleeves up and prepared to do verbal battle with Sainsburys Visa. Not a bl@@dy peep! Mind you the nights young so will let you know. Boy am I in the mood for 'em!!
    On a lighter note (!) got word today that both our Mint card a/cs are being reduced to O% and DMP accepted. Honest to goodness, I don't know if I need a Martini or anti depressants lol.

    Hi Geoffmr1, thats what I am amazed about is the letter that says they will stop all the charges! I take it they don't continue to send statements after you start a DMP.
