    ooh - I don't think I realised that interest is stopped on a CCJ -not that I want one but it does make it seem almost an attractive option - at least with these horrible payday people who have been fleecing me alive the last couple of years. Does the interest automatically get stopped when you get a default too, or is that just wishful thinking?? I have already received one notice of defaut which I guess will sit on my credit file for 6 years anyway, so I kinda figure if I have 1 already, does it matter if I get any more?!?!     I think I will wait on the claiming thing for one main reason - I suspect once I have entered DMP with my bank and I go actually over my overdraft chronically with no means of paying it back (as my salary won't even be going in there anymore) the charges are going to rocket up (unless they are sympathetic and stop interest and charges for the DMP - hmmmmm methinks not!) so is it perhaps best to wait to see how far these charges go???

    Have spent all day writing letters, printing letters, photocopying statements, preparing postal orders, phoning for figure updates etc. I am v looking forward to a VERY large glass of (cheap obviously!!) plonk tonight!!

    It's always a pain at first getting everything together, just make sure you keep copies of everything & set yourself up a nice file where everything is close to hand.

    Funnily enough it seems to be banks that refuse to stop charging interest & also charges in some cases. Must admit I've never had a problem getting them to stop adding the charges on, but I've also never had any luck getting them to stop interest. I sent a strongly worded letter to HSBC & that done the trick with them, they sold the debt on to a DCA & at that point all interest was stopped & the debt has actually started going down.

    Unfortunately, although default notices are just as bad as CCJ's there is a difference. CCJ's stay with you until the debt is cleared, where-as defaults are removed after 6 years regardless of being paid. There has been discussions about whether default notices stop interest previously on here, but in truth I'm none the wiser. I've got 5 defaults & at least two carried on charging interest until they were sold, however, some people believe that once a default has been issued (assuming you don't rectify the notice) then the account is closed & therefore they can't continue adding interest. I don't really know the legal side of that so I wouldn't even try & advise on it.

    p.s. with regards to actual amounts on cards etc, don't worry about that. Once you get your CCCS plan set up and are able to check your balance online (they will send you a password), you can go in and change the amount.

    We're cutting all cc up tonight as sent dmp agreement and statements up today! :j CCCS say it's not going to be until nov till we start so gives us two months with no spends on them - we're just about able to manage by sending minimum payments they ask for until then so hopefully they'll have no complaints (husband getting some commision).

    Well it's all starting for real today - looking forward to it strangely - justhope our creditors are nice with us! :eek:

    Hi Fraggle Im in the same boat about bank charges too. 3 months in a row, their charges put me over my o/draft limit, they're clever enough to take it out right after you get paid as well (so thats how we got into this mess!) Will be interested to hear feedback and advice from anyone about this. I know what you mean about waiting till the DMP kicks in. As you say long way to go but we're getting there!

    Hi, thought I'd drop in and let you know that I started my bank charges reclaiming for £3100 in April against Abbey but the court case was stayed in August 2007. I start my dmp on 1st October 2009 with debts of £21,500. I decided to try the financial hardship route, but didn't think I would be succesful as I didn't have any priorty debts. So you can imagine my surprise when I received a letter from Abbey offering me £360 for the last 12 months charges. The letter also states that they will keep me informed regarding my claim for the 6 years charges claim from 2001 to 2007. Couldn't believe it. It meant that I could pay back a loan of £400 from my mum that hadn't been allowed on the dmp. I feel so much better not owing money to a relative. I say to everyone put a claim in cause you never know how it's going to go. I've now put in claims for all credit card charges and ppi's. Am even looking into claiming back catalogue late payment charges. Good luck to everyone. X

    I got my CCCS pack through on saturday, and a bank account finally - though still waiting on the card etc.. Just have one little question

    I will set up the D/D for future months but this months wont set up in time will it? So i need to make my first payment with the slip provided at the post office - it says there is a charge for this...how much?

    Hi sorry I dont know how much the PO charge is, but I am sending mine by standing order, I just rang CCCS and said I wouldn't be able to make a payment at the post office and they said it was fine and gave me there account number. I can set them up the day before...plus didn't cost anything!;)

  • Thanks Jodan, thats good advice. Daft question, but did you just write a letter asking them to review all charges, or did you have to have statements you could list them from? I dont think Ive kept all the statements as they would fill the house!

    I already had a claim number from original claim in 2007. But they ha:Dve paid out with a different claim number. When I first started the process I requested statements from July 2001 to July 2007, these are still the dates that you must request. I filled in the template letter on the bank reclaiming site on MSE. :D

    Hi tooth fairy, just thought if you go down financial hardship route it would be worth writing them a letter and sending a soa to get ball rolling as it seems they are paying up on some claims for the last 12 months charges as goodwill gesture, but still send off full claim for 6 years from 2001 to 2007. Good luck. X

    I have just applied for their home insurance and been accepted (saving me £8 per month; £96 per year!!:j) but have a CC with them which will be on my DMP.

    Hi MM,
    I wouldn't worry too much, think they're probably completely separate from each other.
    Last year I had house insurance with Halifax,(till I got a cheaper quote this year;)) and also have debt with them.

    We have pet insurance with Tesco, and a cc & loan with them too in our dmp. Like Kudox said shouldn't be a prob!!
